Man won't be prosecuted for driving into yard, killing girl

ALOHA, Ore. – A driver who lost control of his car and drove into a yard, killing an 11-year-old girl last April won't face criminal charges, according to the Washington County Sheriff's Office on Wednesday.

Prosecutors say they couldn't find any criminal wrongdoing by 59-year-old David Herman after he hit another car April 4 while driving south on 160th, kept going and drove into Kylie Hornych’s yard, hitting her while she played with her younger sister.

The car crashed into Hornych’s house after hitting her, mailboxes and a tree.

Prosecutors say Herman was suffering from a diabetic episode when the crash happened.

He stayed at the scene of the crash.
