Too loud? Oregon fan sues Bieber over hearing loss

PORTLAND, Ore. (AP) — An Oregon woman has filed a $9.2 million lawsuit against pop star Justin Bieber, alleging she suffered permanent hearing loss at his Portland concert two years ago.
Stacey Wilson Betts of Wilsonville filed the suit Wednesday in U.S. District Court. It states that the mother of five sustained the injury after Bieber climbed into a heart-shaped gondola and was pulled over the crowd.
The lawsuit alleges Bieber enticed the fans into a "frenzy of screams" by waving his arms, and the sound exceeded safe decibel levels.
The gondola "acted as a sound conductor, creating a sound blast that permanently damaged both my ears," Betts wrote in the lawsuit.
Betts, who attended the concert with one of her daughters, is seeking money for medical expenses, pain and suffering and loss of quality of life. The lawsuit lists Bieber as a defendant, as well as Island Def Jam Records and Vulcan Sports and Entertainment, which owns the arena in which the July 2010 concert took place.
Betts and the record label did not immediately return phone calls seeking comment. No attorney is listed in the court documents.
The lawsuit says Betts has been seeing ear specialists because of hearing loss; severe tinnitus, or noise or ringing in the ears; and hyperacusis, a sensitivity to sound. Supporting court documents show Betts has not been employed since 2005 and has received disability or workers compensation payments for the past year. They also show she has a spouse or significant other who works at a high school.
"I had no reasonable way to anticipate the gondola could create a sound blast that would permanently damage my ears," Betts said in the lawsuit. "Experienced promoters, sound engineers, managers and artists are responsible to maintain safe decibels at all times during their events."

I believe articles have stated she is acting as her own attorney. So lighten up on unfounded and unrelated attorney bashing. I am not an attorney. Common sense says this is a ridiculous claim by a person who is ignorant to the extreme. Disability payments paid for these tickets in the first place? I feel sorry for her kids; what a terrible example of personal responsibility they are being shown. And I am not a Republican.
How did this foolish claim get so much attention? Her day in court should be short. Go away silly lady.

Well, I can't comment on Bieber or his music; I never heard of him...  But I do remember going to a Beatles concert at the Cow Palace in San Francisco in the '60s...and my ears rang for 2 or 3 days afterwards!  It wasn't the music, though; it was the endless screaming of the fans (me included!)... In fact, the screaming was so loud you really couldn't hear very much of the music, but it didn't matter (hey, we could SEE them, and we already knew the music!)... Anyway, after that 2-3 days, the "ringing" went away... no permanent harm done...

Just going by the background info, this sounds very much like somebody looking to spin the "legal lottery"... The bad part about this is that one of the "deep pockets" she's after might very well make a settlement offer, just to keep it out of court... and that only encourages similar behavior by other people. Â
@margay1 I totally agree! I saw the Beatles in '64 when they came to Seattle. OMG..the noise! But as with you, it came from me and all the swarming little girls around me LOL What fun. Ears hummed for a couple of days...but they hummed with the sound of The Beatles...::swoon:: Years later I sat thru a Jimmy Buffet concert (I believe in '96 or '97)...and again it was loud...not the mad, endless din of sound from maniac girls around us, but just from the great beat and music equipment. Ears hummed a bit a day or two later, but nothing more. Had I been that concerned about it, I would have left!! Trust me...this will never get to court. Either due to embarassment or an out of court settlement (I hope not!!)...she'll never get there. This time the "legal lottery" won't spin in her favor. Can you imagine??? 9 Million for osmething you could have averted easily yourself???? OMG!!! Is this woman crazy???
Loud concert, wear earplugs, DUH! I hope her lawyer brings up the fact that her daughter was right there with her and suffered no damage. Unless every person attending had the same problem, then this is HER problem. Doesn't everyone know that concerts are loud? Has she lived in a cave all these years? And, I'm not even a fan, just know nonsense when I see it or hear it. Oh, wait! I attended a Beach Boy concert in the 60's, and now my hearing is failing, it must be their fault! Or maybe it was The Buffalo Springfield show? Or....... I would like to know who the contemptible, despicable, ambulance chasing attorney is that filed this law suit. This lady was talked into it by some legal person who's only goal is to grab a contingency fee and justify their self righteous career.

This says a lot more about the sorry state of our legal system. She never should have been able to find a lawyer that was willing to file a suit. A waste of time and money for our legal system.  There should be a fine for filing frivolous lawsuits, for the lawyer filing the suit!!!
Noise. Flashing lights and movement. Â Screaming. Â Large amounts of all of these are how a concert goer (and artist) measures the success of the concert that they are attending. Â For a woman to take her daughters to a concert and then file a lawsuit like this is ridiculous and frivolous in the extreme. Â Don't concerts already come with a sort of warning on their ticket label anyway? Â I know my Katy Perry tickets did. Â So stupid. Â I hope now that the cogs are in motion she feels stupid and ashamed of her actions. Â These sorts of idiotic actions are what ruin the rest of the world for us sane people who don't expect everyone else to protect us from ourselves.

Two years later? Where has she been in the mean time, and in what activities has she had exposure to sound since this concert? Exactly what level of sound did she experience? At what point are we responsible for our own decisions? If as a parent I allow my child to go to a concert or take her myself then I am responsible and no one else.

Talk about silly, superfluous cases - this is a perfect example...also, a greedy gal looking for something she did not earn. If she is old enough to file suit she is certainly old enough to know attending such performances is a danger to her hearing and should have taken precautions.

What happened was that she joined the Occutard group and then realized she could potentially live off the success of others. This is why she is trying to settle with beiber, because she does not want to go back to work after two years of unemployment.

Although I have real problems with her lawsuit, I went to a Kenny Rogers concert years ago. Sound was painfully loud. And for all the commenters, no, I did not wear earplugs. I thought I was going to hear the music, not to have to block it out. The lawsuit may be bogus but it still makes a point. Most concerts are so loud that saying it is "excessively loud" just doesn't come close to describing it. If Bieber, or any other entertainer, really cared about his fans, he would make sure the sound produced was within tolerable levels. Deaf fans are not going to buy the music. Trust me, I know.

As for the 'lawsuit', I personally think it's funny. As soon as the bailiff called her name and she stood up, it'd get tossed out. But, if she can avoid such bald-faced chicanery, maybe Berber..er, Bieber will have to appear per the summons. It'd be a higher quality event than the scheduled benediction that Obama is supposed to 'grace' Portland with in the next month or so. (That's not saying much tho, since a museum exhibit displaying the 'Cultural Greatness of Haiti and It's People' would still outrank THAT circus!)

Seriously - if you are going to a concert, you know the music will be loud, and the crowd will be louder because of it. Bring ear plugs and wear those along with the ear protection muffler gear used in target shooting.Â

I might have to sue Ms. Betts for "permanently losing the 30 seconds of my life it took to read about her insanity". I think $306,666.67 per second is appropriate (do the math) compensation. Oh, and before you say that it was my choice to read the article - it was also her choice to go to ROCK CONCERT, not a library.
