Mother files lawsuit saying Terri Horman kidnapped Kyron

PORTLAND, Ore. – The mother of Kyron Horman, the young boy who vanished two years ago, filed a lawsuit against the boy’s stepmother on Friday claiming that she is “responsible for the disappearance of Kyron.”
In the lawsuit, Desiree Young directly asserts that Terri Horman kidnapped Kyron. The suit also claims Horman “intentionally interfered with [Young’s] parental rights and that Terri Horman intentionally inflicted severe emotional distress.”
The suit goes on to say that Young “seeks the return of her son and seeks compensatory damages.”
Terri Horman was the last person known to see Kyron alive at Skyline School on June 4, 2010. She has long been the focus of the investigation into his whereabouts, although she has never been formally named a criminal suspect.

"I haven't been able to see my son, hug him, kiss him or tuck him into bed," she said. "I hope that I'm wrong but I fear that he is gone forever. I believe Terri Horman knows where Kyron is."
Terri Horman's lawyer Stephen Houze issued a short statement saying he would not comment until after he had the chance to "thoroughly review" the complaint.
Nobody answered the door at Horman's house in Roseburg, Ore.
While there is still an open criminal investigation into Kyron’s disappearance, this suit is separate from any potential criminal charges.
In the suit, Young’s lawyers wrote that Terri Horman “feigned ignorance of the circumstances surrounding the disappearance” and “lied to investigating authorities and to the media regarding her activities on June 4, 2010.”
Young is seeking $10 million in damages from Horman.
She said she doesn't plan to keep any money she might win from the suit. Rather, she plans to donate it to families in similar situations with missing children.
"I don't want Terri's money," she said. "I want Terri to face justice."
Meanwhile Kaine Horman, Kyron's father and Young's ex-husband, said as long as the lawsuit doesn't interfere with the criminal investigation he supports it.
"I think all the boundaries are set appropriately and not crossed," he said. "Everyone's goal, regardless of which case, is to bring him home as quickly as possible."
Civil versus criminal case
Civil lawsuits involve a lower burden of proof to be found guilty than criminal indictments.
In a criminal case a defendant must be found guilty "beyond a reasonable doubt." However, in a civil case a defendant must only be found guilty based on a "preponderance of evidence."
"I explain to people as if you have a scale and drop one grain of sand on the scale, that's all you have to show for preponderance of the evidence. So it's a very low standard," family law attorney Drew Bobzien told KATU on Thursday. Bobzien is not involved with the Young lawsuit.
Young's lawyer, Elden Rosenthal, said he intends to use subpoena power to uncover new evidence about the case, including e-mails and text messages.
"There are tools available to me that will allow us to peel away the mystery surrounding Kyron's disappearance," he said.
Horman would likely be able to avoid testifying. Because the possibility of a criminal trial still exists, she would be able to invoke her Fifth Amendment right against incriminating herself.
Even if Horman exercises that right, Young said "we still will prove the case."
Rosenthal and his team will have to prove that Horman took Kyron with the intent to hold him “permanently or for a protracted period.”
According to legal analyst Bruce McCain, who has closely been following the Kyron case, the suit will be “near impossible to prove, especially when an element of second degree custodial interference is that Terri acted with the intent to hold Kyron permanently of for a protracted period of time.”

There have been conversations among Americans concerned about Kyron about his step-granny and step-grandpop. Will Carol(e) LOGAN Moulton and hubby move back to Grass Valley CA when Terri Horman skips out of Fort Moulton? Â Do they still have relatives there? Â Will those who bought Kyron (as is the theory conclusion) need to wipe up all possible leaks? Â Will the Moulton's friends and associates think about that and distance themselves from the Moultons?  @Kyron Supporter God will provide perfect justice to all who have caused scandal to a child.  Jesus said so.  The seller, the assistant, the buyer, ALL of their supporters and protectors have sealed their eternities in never ending agony.  Only one way out.  Release Kyron, taking him to a Police Station or Emergency Room and turn yourselves in, or leave him there and run and try to hide.  Maybe get on one of those lil' airplanes that scoot down to Mexico.  You know about that.  Once you return Kyron, you have options of pay now or pay later.  Make no mistake, you WILL pay.  Ouch. Be very afraid that you will die before you return the boy or before you confess.  You know the pain and suffering you have caused the boy, his mother and father and his family and friends.  You will understand that pain.  His friends are in every State in the USA and Australia and many other countries.  They are not lacking in skill, intelligence, or commitment to this specific issue, which involves many relative issues, people and areas of our country and internationally.  Concerned citizens are gathering all information and organizing as citizens can do.  The focus on Kyron started immediately upon news of his being "vanished."  The attention segued directly from the Torry Hansen debacle in Shelbyville, TN where she allowed her mom to put the 7 yr old Russian boy she had adopted as a single unemployed female, on a plane airmailing him back to Russia alone.  Although Russia considered her a child abuser and closed adoption of their orphans to all Americans, the US State Dept. claimed in a televised interview they had not and would not question Ms. Hansen, they had no reason to question Ms. Hansen, but their team was flying to Russia to get them to thaw the closure.  Americans were again astonished.  What was going on.  Who are these people that cause a country to label them as child abusers and close their doors to adoptions by Americans yet no US official will ask the perp a question.  What contacts, what power, what money those people must have.  Reporters discovered another boy living in Torry's household who was not mentioned in the required Application information for adoption per Russia.  Reporters could only find that the boy's name was LOGAN.  They could not identify his mom or dad.  The Shelbyville School system Superintendent said neither the Russian boy or any other boy residing in the Torry Hansen household, namely Logan, were ever registered for private or public school and were never registered for home schooling.  Townspeople indicated the Hansen's were reclusive, had fenced barricades joining the home of Torry and her adult sister, their mom/pop's home and other relatives in another home.  After the international news about the airmailing of the Russian boy back to Russia, some of the Hansen group moved back to the areas which they left in California to live in TN.  They lived in in a community outside Nashville, then Chapel Hill where Torry and family member(s) and LOGAN lived and the Hansen's sold other property with home and buildings.  News vaguely reported fights between Torry and a neighbor who accused her of taking pix of his little son when playing in his yard and she ignored his orders to stop... so he took his camera out and photographed HER taking pictures.  Several neighbors asked her to remove the house trailer she owned that was unused, except for a lot of video and camera equipment that could be seen through tears in the blackplastic sheets covering the windows.  She instead painted it gaudy colors, had speakers play loud music at all hours, and floodlights on it.  Sheriff resolved it.  After the publicity about the airmailing of the Russian boy in Shelbyville, some of the group returned to Hayfork, CA and Redding, CA.  Provable that Nancy Graham Hansen and one daughter were back in Redding where they took a Redding area videophotographer/producer to small claims court because they had tried to buy his videobusiness or studio or equipment and there was some conflict. They signed on June 10(?not sure of day at moment) 2010.  Jumping to recent information, suit was filed for Torry to pay child support for the benefit of the Russian boy. She explained she had been unable to attend some Hearing(s) because she had given birth to a baby girl.  Well, she had wanted a boy through adoption and likely she couldn't get help from an adoption agency again so the single unemployed female somehow became pregnant and got her kid.  Interesting area between those CA towns and up to Portland.  Torry's mom Nancy Graham Hansen was born in Grass Valley, CA.  Married in Las Vegas.  Terri's adoptive parents lived in Grass Valley and her mom Carol or Carole LOGAN Moulton was born there.  They adopted Terri in Grass Valley and moved to Roseburg, OR.  Small world indeed. Some of this information is theory, some conclusions threaded, but the facts are facts.  Advice to those involved in harming Kyron or having information, for the sake of your eternity, protect yourselves now.  Our lives are short no matter how long, but our eternities are eternal.  Be very afraid of not helping your eternal souls now, tomorrow may be too late.
