COWLITZ COUNTY, Wash. - Is the Cowlitz Indian Tribe trying to build its multi-million dollar mega-casino in Clark County on land that was never its traditional territory?
As a federal judge weighs that very question, KATU News has learned some tribal members are challenging their own leaders’ right to run the project.
Cowlitz Tribe member Steve Myers and his cousin, Thomas Hill, showed On Your Side Investigator Dan Tilkin internal tribal documents that raise new questions about whether some leaders of the Cowlitz tribal council even belong in the tribe.
“They’re not Indians,” said Myers, who is a card-carrying member of the Cowlitz and whose family has long played a role in tribal affairs. Myers' aunt – Hill’s mother – was tribal secretary in the 1950s and 60s, taking over the position from her mother who served as secretary for decades before that.
It’s through Hill’s mother that the cousins came into possession of documents that cast doubt on the degree of tribal ancestry of three of the top eight administrators of the tribe. In other words, there are questions about how much Cowlitz blood they actually have.
| The BIA and the Cowlitz Blood Quantum Requirement Federal officials themselves acknowledged problems with the Cowlitz enrollment records and the calculation of blood quanta when they issued their official recognition in 2000, stating that “90 members do not appear to meet the petitioners own eligibility standards” and that “the blood quantum of several new members who did not meet the minimum eligibility of 1/16th was calculated as much higher than the actual Cowlitz blood quantum.” Tribes are also obligated by law to adhere to the eligibility standards they adopt. Tribes can legally change them – but that can cause real problems, according to the BIA: “Inconsistency in the application of eligibility standards leaves a tribe open to serious membership disputes and to lawsuits and raises issues under the Indian Civil Rights Act.” (Final Determination For Federal Acknowledgement of the Cowlitz Indian Tribe, page 193) The Cowlitz aren’t the only tribe facing questions about lineage and legitimacy as casino money hangs in the balance. Right now the Snoqualmie Tribe, which runs a casino resort near Seattle, is going through a vicious fight amongst its own members over who is legitimately in the tribe. |
That standard – called a blood quantum – helped the federal government decide who qualified as a real Cowlitz member when the tribe was granted recognition in 2000. The standard was a minimum 1/16th Cowlitz blood.
Tribe members now are entitled to share in any future casino proceeds, as decided by the tribal council. Membership also meant access to tribal-related benefits – subsidized housing for example, or monetary compensation.
Records show the tribe took the question of who was a ‘real’ Cowlitz very seriously – Bureau of Indian Affairs (BIA) documents show controversies over qualification split the tribe in the early 1970s. The 1/16th rule was also used to disqualify entire families from having a voice a in tribal affairs (Anthropological Technical Report, page 89 and 105).
That is why Myers and Hill were shocked by the information they recently uncovered in enrollment documents they say belonged to Thomas’ late mother, the former tribal secretary. The documents lay out the relations used to establish the blood quanta of tribal administrator Carolee Morris, human resources director Nancy Osborne, and – by association, since they are full siblings sharing the same parentage – their brother, tribal enrollment officer Randy Russell.
The enrollment documents – signed by Osborne in 1974 – say she’s 1/8th Cowlitz Indian. But five years before that, just 1/32nd.
The documents on Osborne’s sister, Carolee, also show changing fractions of Cowlitz blood. A third enrollment form uncovered by the cousins and provided to the On Your Side Investigators suggests Morris’ blood quantum level – and therefore shared by her brother and sister – might actually be as low as 1/64th Cowlitz.
That means they wouldn’t have qualified for full membership in the tribe using the 1/16th standard on the books when the federal government officially recognized the tribe. Keep in mind, Morris has been a tribal leader since the 1970s and records show her sister, Nancy Osborne, representing the tribe since the early 1990s. That was all during the time when the Cowlitz were barring others from membership because they lacked a 1/16th blood quantum.
Just months after the federal government recognized the Cowlitz as a tribe its leaders convinced tribe members to change the tribal constitution and remove any minimum blood quantum. Both Nancy Osborne and Carolee Morris held tribal leadership positions at the time.
The KATU On Your Side Investigators tried talking to each of the tribal leaders about the documents provided to us by the cousins – the answer was no. Instead the tribal chairman leveled accusations of his own, writing in an email, "These records are stolen confidential records. Please return all of the records you have, as they are tribal property. They are out of date, incomplete and inaccurate. Our roles are certified and confidential. For further inquiry about enrollment or tribal records, I will refer you to the BIA."
But when it comes to bad blood, the Bureau of Indian Affairs refuses to get involved. In a statement, the regional director here in Portland told KATU they “don’t determine tribal membership… that’s internal. The tribe sets the standard. We are not privy to knowing their lineage.”
Lawyers representing Clark County in their challenge to the Cowlitz casino proposal say tribal membership is not something the federal judge would resolve in her land use decision.
But the cousins hope these documents that question whether the people who stand to profit from the casino even belong to the Cowlitz tribe, will convince Cowlitz members to rethink their support of their leaders.
"They become recognized, then after they become recognized they changed the rules, because none of these people met the blood quantum to be enrolled in the tribe prior to recognition,” said Steve Myers. “They rewrote history."
His cousin, Thomas Hill, last week filed suit against the tribe in federal court, seeking to have the 1/16th blood quantum requirement reinstated and all who fall short of it – including Carolee Morris, Nancy Osborne and Randy Russell – be struck from the membership roll.

Personally, rather than cut off enrollment at 12 months old, Does not make the least bit of sense if you have tribal enrolled family members! According to Rod Van Mechelen..... To be a member of an Indian tribe is to be a member of an extended family, and it is about both heritage and inheritance. We as Native Americans should welcome all of those into our heritage that can prove ancestry regardless. At least those that have not lied about it somewhere along the lines!!!
Personally I think that those leaders that lied or had falsified enrollment documents with changing Blood quantums should not only be prosecuted, But should actually be the ones banned from the tribe! If we can not trust over so called leaders........ Whom can we trust!

All you have to do is read the first line of this "news article" to know what this is all really about!
all they have to do is look at auntie earnies paper work and be done with this in a cpl minutes considering those are ALL HER CHILDREN...its obvious that there is some other underlying issues here, such as possibly another tribe paying these two duche bags $ to stir up stuff...i believe i did hear them claiming that Clark county isn't in our area (wich would go hand in hand with what a tribe from OREGON has been claiming)...the lewis river band covered that area...these two make me sick to my stumich and thankful that i am in active sobriety...idk about the lil meyers guy, but its obvious that tom hill has some pretty serious issues...why would Meyers who is a tribal member, and who could clearly benefit from casino earnings want to argue on blood quantum...am i trippin or does this dude have green eyes???...im shure his kids wont qualify...are they going to have children within the tribe?...200 years ago these two would be taken out in the woods and dealt withÂ

native american i would be proud of it and would not care who knew that i am indian but if you have something to
hide or need to change something i under stand there way of controlling things according to what i have been

Not sure why Dan Tilkin did this story it appears that thes documents were not for public viewing just like an application for credit card should not be viewed on camera. Shame on channel 2 for falling into someones angry plot.  Why would two cousins Steve Myers and Thomas Hill go to the News media with a document that should not be in their possession in the first place. It would be interesting in finding out why they didn't give the documents back to the tribe when they found it. It appears that the family had something against the Russell Family prior to Hills passing were the documents altered is this true documents so many questions it appears that is is one family against another not doing much to say anything else. I know the tribe will probaly do a story to clear the waters but what does this really prove. One thing I would say the Russell family appears to be trying to help the tribe and the Hill and Myers family is trying to give the tribe a negative inpact just because one family is against leaders trying to make tribe self sufficent

My question is, in a time when we have DNA testing, why are we not using this to prove blood quantum? I'm afraid many people would be disqualified, but on the other hand, many others might be fairly recognized.
What do you mean? It's always been a tribal tradition to build casinos.... Clear back when the Pilgrims landed the Indians helped them through their first winter by showing the new comers how to deal Blackjack.
How could the tribes survive by just selling fireworks, and cheap cigarettes? I say even if you might have set next to a tribal member on a bus at one time in your life that should make you at least part indian.

I for one cannot see any connection between tribal heritage (a fine thing to hold on to and pass along) and operating a casino. It is about as far removed from Native American tradition and culture as you can get. It's always struck me as hypocritical and culturally dissonant to live on a reservation and operate a casino.

You people aren't listening. These men are not out for the MONEY. They just want their Cowlitz Tribal members to know what is going on with some of their leadership. They have been trying for years but no one listened because of the promises of money from the CASINO. Other leaders would kick people out for speaking their minds. Now you still won't listen, but someone is. You don't realize how lucky you are that men with real family records and proof are not afraid to speak. Their lives and reputations are at stake. They have been threatened and worse. Dan Tilkin is the only who listened all these years and he didn't do it with blinders on. This is not about money this is about family and heritage. The tribe needs to stick together and be strong just like their ancestors were. Make the previous Chiefs proud of all of you. Look at your family pictures from the late 1800's or early 1900's and think of what they would truly want you to do. These men were proud of their Cowlitz ancestors and are doing this for them. Myers I am proud of my ancestors..but one of these are from a different tribe ( HMMM) the other is stirring the pot because maybe some southern tribe wants to stir it up to protect their CASINO... Our tribal leaders were elected by the GENERAL Council. My original card is from the 70's..Joe Cloquet was the Chairman..we all gathered in a grange hall in Toledo..we voted...We are getting close to the Casino in La Center and i think some have sold out to the southern tribe...bad times when Natives fight against natives to make a buck

im a cowlitz tribal member...one of the head singers, a canoe skipper, and an active member of the tribal journeys...tom hill and that meyers guy are NOBODYS ...i am 200 miles away attending n.w.i.c. and i do more culturaly for the tribe than they HAVE EVER DONE...we have many songs, we carve, sing, make give away gifts and also teach our culture to the children as well AS THE SONGS...our children can sing better than these two guys EVER WILL
Could it be that Dan Tilkin and the producers at KATU have based a story on something other than facts? Is it possible media sensationalized to gain viewers? Congrats to all the commenters on here who fed into this story. Job well done KATU, looks like you got the hype you wanted however, you failed again in publishing facts and looking into the background of these two men and their relations with the Cowlitz Tribe. People wise up, how many times have we been told not to believe everything you hear. And for God sake not every Native American is out for money from a casino. Is it possible we take pride in our heritage, culture and want to continue to teach our children the Native beliefs without being ridiculed by non natives? Does this mean Itialians, Irish, Sweedish and so on should stop installing their cultural values on their children. I was adopted, had to prove my heritage when I was near 30 yrs old..... the tribe enrollment says my children cant be enrolled because they are over a year old..... They have as much right to be a member as any enrolled tribal members! It saddens me that they are afraid it would cost them a share of the money...... That none of us enrolled tribal members have never seen a penny of yet anyway.........when we should welcome more tribal members!

so sick of hearing about benefits for native americans. time for the country to move on, for all benefits/subsidies to natives to end, and for everyone to be treated the same. Ever been to spirit mountain and seen the tribal members? They are some of the whitest people around. Just because you have a long distant relative that was native doesn't mean you should get special financial benefits.

As if it would be the first treaty or agreement to be phased out? I don't believe we owe them anything at this point. They make plenty of money off the casinos and it is unreasonable to continue to pay for these people. They have made enough money in their casinos that they can buy some undeveloped land and go back to living off of it like they did before the European influence. Oh thats right, they don't want to live that way, they want cars, trucks, technology, etc just like the "americans" not native.

@none Once again I will say to you I respect your opinion. I personally am proud to say that these three outstanding individuals work very hard for our Tribe, our Elders and Youth. Our resevation and Casino project is not for individual financial gain. You should take the time to check out our webpage and see the other programs that the Cowlitz Indian Tribe has. Do you know anything about the dwindling Smelt and Salmon populations here in the State of Washington and who is fighting for their restoration??? Please do me a favor and do your homework a little better before your next negative comments. There is more to the Cowlitz Indian Tribe than you can imagine.
i have a neighbor who is 100% Â Cherokee, yet it is her father that has disowned her, and her mother has zero say in her heritage. Does the family actually recognize these men, or are they pulling people's legs, just to get rich?

@boned @washcomom How do you know she was 100% Cherokee? MANY people claim to be Cherokee and their tribal records are so messed up that they have given up trying to determine who is/isn't a tribal member. I get a chuckle when so many people tell me they are part Cherokee, but don't know which band. And very few people ever describe themselves as being from other tribes. The Cherokee tribe was actually very small compared to most of the others. Most true natives chuckle when told by someone that they are Cherokee. And of course, people who are 1/32nd Indian are not interested in revenue from casinos (sarc). Anyone who believes that is either unfamiliar with the culture or wanting to keep the monies earned to themselves.

That's why tribal "genealogy" is so important - - to keep the records of the known members of the Indian Nations on their books, so they can prevent the scumbags that use fraud and deception - like these women (Carolee Morris and Nancy Osborne). You say your identity was stolen before, so why is that you seem to not understand that is what is happening to my Tribe and confidential documents that have been used innappropriately by two individuals with their own misguided agenda??  @washcomom Are we not ripe for this kind of deception under Der Leader that seems to have no problem with it since he himself is guilty of it??
