Court won't hear challenge to Clean Air Act rule

WASHINGTON (AP) - The Supreme Court won't hear a challenge to a tough new clean air requirement limiting sulfur dioxide emissions.
The high court on Tuesday refused to hear an appeal from businesses and industrial interests involving an Environmental Protection Agency regulation setting emission levels of sulfur dioxide, a colorless gas with the smell of rotting eggs. Sulfur dioxide from power plant smokestacks can be carried long distances by wind and weather and has been linked to various illnesses including asthma.
Several corporations and industrial associations along with several states say that EPA's required emission levels are lower than mandated by law to protect public health. But the U.S. Court of Appeals for the District of Columbia Circuit refused to overturn the EPA's decision.
The justices refused to reconsider that ruling.

so in other words, again the EPA owns the courts. the courts are slowly making themselves less relevant.
This will drive more company overseas.

Not likely, these were mostly energy companies running coal fired plants. You really can't move a power plant. You can close it down, but that's more expensive than to keep operating it.

It affects a lot of companies.

The power companies will have to increase rates which will increase costs for businesses which will decrease their ability to stay competitive in a world economy and will look for ways to cut costs. The biggest way to cut costs is to move overseas.

For every action the government takes there is a reaction among businesses. California is losing lots of businesses and tax payers to other states because of their high energy costs (along with taxes and other regulations).

Already I have several relatives who are slowly moving their operations to China and laying off US workers. Most of the reason is 0bamacare but this will just make them move quicker. They are going to school to learn Chinese so they can function over there.
Must be nice to just make up rules and have them enforced as though they were laws.
