Police: Waitress tacked on tips at Tualatin restaurant
TUALATIN, Ore. - Every time you hand over your credit card at a store or restaurant you trust the server or cashier to use it honestly. But "On Your Side Investigator" Dan Tilkin discovered that's not been the case at one popular place in our area.
The waitress, Haley Rogers, at Famous Dave's is accused of ripping off dozens of customers, and Tualatin police wonder if there may be more customers who were ripped off, considering the waitress worked at the restaurant for a couple of years.
Police say approximately 80 customers got ripped off when Rogers rewrote their credit card slips and changed the amount of her tip.
A KATU News viewer who was a customer alerted us about what was going on and wrote that a "group of us (8) went to Famous Dave's, had bad food, bad service, etc. so the tips (3 separate checks) we left where (sic) all around 10%. Our bill was $100.91 and we tipped $10, then when it cleared our bank account the server had changed our tip to $20."
After the customer complained, Famous Dave's went through credit card receipts over a 19-day period from mid-September to early October and then reported the 80 altered receipts to police. That's about four altered receipts per day.
According to court records, Rogers spent six days in jail for another theft case.
Tilkin went to Rogers' apartment to ask her how long it’s been going on. At first, it seemed she was going to speak with him but a moment later she shut the door and never came back.
Tualatin police have only been able to reach nine of the customers whose credit card receipts were changed.
They want people who think they're victims to call them at (503) 691-4800.
If the owner was smart, he would have fixed all the charges, offered the customers a free meal, and fired the girl. Reporting it to the police was a mistake. Although the girl should pay for the crime, the owner is now paying more than the girl. I have never been to Famous Dave's and now I probably never will. While I appreciate the manager looking further into it than just the theft that was reported, this media attention has drawn out a lot of negative reviews in the comments section. I imagine they will lose a lot of business from this.
I usually tip 20% when I have the 2 year old with me if I get good service. Â Without the 2 year old it takes excellent service to get 20%. Â Adequate service gets you a 15% tip. Â Substandard service gets you about 5% regardless. Â Substandard service includes never seeing you again after the food is delivered, slow kitchen service, especially if I'm waiting with a hungry 2 year old, or an unhelpful attitude. Â If you smile, get the correct food to us on time, and keep my water glass full you'll get the max tip. Â And when I add the tip I add a small additional amount to reach a set number of odd cents. Â All my restaurant tickets end in the same number of cents. Â If it's off I know there's something going on.
I have a Capital One card that I've set up to send a text message to my cell phone on ANY transaction against the card as soon as it happens....in about 1 to 2 minutes. Â Usually before I leave the restaurant or store. Â I was just in Maui and was charged twice for one item. Â I showed the alert to the store and they fixed on the spot. Â I think most cards offer this service. Â

Good i pay cash all the time in restaurants...you never know, Â people has alot defects..i think she will not gonna work there anymore..
whats even more amazing is the lack of follow through from cashiers who actually handle my credit card - I don't sign my credit card, but rather I write on the back 'ASK FOR ID' and out of 20 uses, only 1 or 2 cashiers actually ask to see my ID.....that's a shame.
 @Keith In Washington it is not required by law to check ID, even if a card says "CID" or Ask for ID....a retail company I used to work for told employees not to check ID, loss prevention would take care of anything that happened.

 @Yvonne     Just an FYI, the state councils homeowners to write dual party checks to contractors too. It doesn't make it correct. Most banks will not accept a dual party check.
Also, I highly doubt any police dept. has ever read the 23 pages of micro print rules that govern each different credit card in the US.
You card instructs you to sign an "authorized signature" and then says "Not valid unless signed"Â So SR is correct, no clerk should accept an unsigned card because it is NOT valid.
 @Yvonne ha..well the police don't write the contract with visa/mastercard. Look at your terms and the merchant processing terms. They definitely don't have to accept a card that is not signed.
@SR @Daniel C @Keith No it does not. I have actually had the police coucil to do it that way. It is an added protection to the consumer. I write "Ask for Photo ID" - that way they have a picture to compare to along with my signature on my DL.
I think she was stealing tips to fix her teeth...
I always cross out the tip line or write NONE and leave the tip in cash if I end up paying with a card.

i went there once and the service was horrible the food tasted burnt i had to ask about 4 diff waitresses for a high chair for my daughter before i actually got what i wanted. You know something a typical 2 year old needs before she can eat ! very rude people ill never go back there again

I tip on how well my service was for my meal. 10% if it was awful, 15% if it was good and 20% if the service was over the top. I also watch my receipts really closely. I think this girl should be ashamed of herself. She will get a slap on the wrist and be send out into the world to screw more folks out of their money. Greedy!!
I dont understand why you would tip at all if the service was horrible. You dont pay your roofer if he says hes done with your roof and it still leaks. Why would you pay a server if their service wasnt satisfactory. On the other hand, if your service was exceptional, you should in turn, offer exceptional compensation for a job well done. Be realistic here, if someone thinks their service is "just good enough" then they will never strive to improve it. You, by paying them for bad service, are enabling them to continue giving only the minimum.

 @SR Because people are not dogs. If the server is rude, that is one thing, but if they are just overwhelmed because of circumstances then I give them the benefit of the doubt. It is not my job to train another human being with doggy treats.
Tipping for bad service is like giving a dog a cookie when it craps on your rug. Why encourage a poor performance.

I usually tip 20% for average service and 30% for exceptional service. I'll even tip 15% for bad service because I know everybody has bad days, but if I get bad service from the same person twice......You get a nickel. At bars, I have been known to tip up to 50%, but then again, at bars I'm usually drunk. lol

For the people out there who don't tip or give bad tips even if you get great service. You have to realize the server has to tip out other employees as well. The busser,bartender, food runner, sometimes the kitchen. At most places tip out is based on sales not ok how much money in tips you receive. So if I serve a table and they spend $100 I have to tip out 3% of my sales. Which is $3. Doenst sound like much but if I don't get a tip from that table I now have to pay $3 dollars to wait on them. After a few cheap people that can add up.
 @Courtney Sorry for the cheap people but glad to here if they really sucked it cost them more if I tip nothing. I usually don't because of the tip out and I don't want to screw the others. Knowing it actually hurts the one providing the poor service helps and is probable done that way to make sure even they lazy servers try harder...
 @Courtney You should also mention that many restaurants require you to pay a tip on parties of 8 or more even if the checks are split up.  I personally don't like this trend I still want the wait staff to work hard for their tip and if they do they will be rewarded so.  Back when I was a server I was paid less than the minimum wage and was taxed at 8% of my sales.  Dishonesty has no place in the service industry Famous Daves will pay the price for this person, but really people if you received good to great service then you should tip as such and you likely would have not been in this situation.
@Courtney Not every restaurant requires tipping out cooks or runners. In fact, many many do not. On top of that, you are receiving a wage, plus your tips, if you provide good service, you will likely get good tips(yes occasionally there are rude or cheap people but thats part of the game). I have friends that work as waitresses currently, some make good money and some make not so good money, what i know about them, is its less about where they work, as it is about how hard they work.

Either way, this woman should be arrested and fined for theft as well as ordered to pay back all the money plus a gratuity of her own. That money cost those people interest on their credit cards, so it wasnt just the "tip" that she caused in damages.

I believe a tip should be given,but what she did was wrong. I also know that if I get bad service,bad food,etc. a tip will not be given,and I will not go back to that place. If the service is really bad,Management will be spoken to. This gal changed the tip,with no authority to do so,and stole money out of this persons account. I am glad she was caught. A tip is something that is not required,so I do not agree that tips should not be included in the food bill! People better be keeping a look on their accounts.
This is why I like Europe's system, the tip is included in the price. You pay what's on the menu, if the service is bad you complain and they either make it up or it's free. Here in the states tipping is subjective and that often leads to things like this, not that it excuses this young ladies theft. Stealing is still morally wrong and illegal no matter how good her reason.
 @Jennifer Havens They don't tip is South America either. I was eating at a Cafe in Argentina with a friend from there. I tried to leave a tip, and my friend asked what I was doing. He said if I left money on the table, he himself would take it. I think tipping is a north american phenomenon, but the pay structures for servers is set up as such, so I still tip well.

@Jaqen H'ghar Believe it or not people can pick up on your attititude.Ive been in the business for over two decades and I absolutely love what I do.There will always be assholes in any kind of job that involvest public service but I find the nice people make up for it?

How greedy.. What most Oregonians don't realize is many states don't require restaurants to pay minimum wage, for example, in Ohio waiters are paid about 3.00 an hours plus tips, here in Oregon is 9.00 an hour plus tips.. when that 15 to 20% tip was made the law of etiquette this is what was considered .. For this girl to be paid 9 dollars an hour plus tips and then charge more is just plain greed..

If all of them are full, that means you get about 2 minutes per table per hour for all their needs - taking drink orders, taking food orders, delivering drinks, delivering food, checking in on them, refilling glasses, taking additional orders, getting them boxes and their check, etc. I've worked in restaurants and seen some excellent servers and the most you can really handle and not give bad service is about 15 tables. Otherwise you're spread so thin that diners end up waiting a long time before they get things like drink refills, boxes, and the check. Had that issue the other night where a meal that should have taken an hour took over two because the waitress was spread too thin.

And yes, even common restaurants like Red Robin, IHOP, etc. make you memorize and know a lot of things. It's about more than just the special of the day. I watched as the servers were quizzed on every single item on the menu, what it came with, the options, substitutions available, etc. It has become more and more common for restaurants to have you know all about the wines, the seafood, and any special ingredients they may have. It's certainly become harder than it was over a decade ago when I worked in a restaurant. While it may not be "skilled" in the way that being a doctor or an engineer is, but it still takes a lot of work, knowledge, and skills.

My interest is in wine.Besides just knowledge,I'm always impressed with people who can tell you what kind of wine and the different blends just from one taste.I would consider that a skill that I would like to acquire.I have a palate for basics but a person can never stop learning about wine and tasting ability.

Maybe i got lucky, or maybe i was just good at my job, but the amount of "skill" it took me, was next to nothing, i made sure the order was correct, on time, and kept my customers well supplied with anything they needed to have a good meal. In meeting and hanging out with these people I learned how to learn. Their survival skills in the woods astounded me; I thought the Navy had taught me something, but hell no. I was even taught how to "feel" true north underground in a cave. To this day, I can't figure out how that guy taught me, but 30 years later I can still go underground, shut my eyes and know which way north is. I have been in college for a while now, have taken math classes up to college level trig, 3 physics classes and none of the instructors can explain it either. So, that skill, even though I don't understand it, is not from school.

I was not referring to it as rocket science. I am talking about a woman spending 8 or more hours a day running back and forth with (at times) 3 loaded dinner plates on each arm, knowing who gets what at what table, sure you don't need a degree, but it is still a skilled job. Guys don't go to college for four years to be a logger. Do you think they are unskilled also? They are skilled enough to run up and down the side of a mountain all day; not all of them use a chainsaw, some are choker setters, I met more than one over the years who could not hardly read, but they were skilled enough to do their job safely. If not, people could die. I, contrary to the name, have done my time in college, got my degree, and yes, utilize it. But the jobs I have done over the years that I did not need my degree for were just as skilled (in a way more) than any job sitting behind a desk. Most of the mo-rons I took classes with could not find their own a-ss with both hands, yet they (I guess) passed the classes. A lot of skills cannot be taught in a classroom, a degree does not necessarily mean you have more skills that a high school dropout, just different ones.

@B Smizzle @B @dougrpdx if you go in for a interview you will be asked about different kind of seafoods,which oceans they live in,whether they are high fat,low fat,texture,taste.You will be asked what wines pair best with different foods.How the wine is made,what are the differ blends in dozens of wines.What country they are from.What wines comes from what regions.All the different parts of a cow,lamb ect.As far as dealing with up to ten tables at a time with several courses drinks,explains the menu all the while separating multi checks.You can take 25 tables? That's total b.s.First of all I would never hire you,second of all I would love to see you put your money where you're mouth is then laugh at you when you fail miserably.

Most wait staff do have a strong work ethic, I am not saying they do. Â what I am saying is their job is low to no skill that is why someone without a HS diploma can do the job! Â Not putting anyone down, just facts!Â

Also scrubbing a toilet = no skill.....anyone can do it! Â That does not mean I don't appreciate what they do, or question their work ethic, quite the contrary they are doing something that takes a lot of manual labor and is not the funnest thing to do......appreciated, yes....skilled, no!

If I was on your wait staff you could fire half them, I would take 25 tables and the party of 15 and you would hear nothing but what a great waiter I was and what a great attitude I had even though the kids were screaming, yelling and tossing food at me....I would do it with a smile.  I have never waited but it does not take a rocket scientist to write something down then deliver it!

Waiting table takes NO SKILL that is why when someone does it poorly most people feel obliged to not tip them well....I wait tables every night at my house...and do the cooking and don't get tipped.
@iamtroglodite With some conservatives you're dammed if you do or dammed if you don't.The unemployed are lazy leeches who are sucking off the government.When they do bust their ass going to dozens of restaurant interviews and finally land a job,they are still worthless low end of the totem poll pond scum.It boggles my mind.I never ever put down anyone that has a strong work ethic and is willing to work with the public or people who scrub toilets for a living.
@iamtroglodite I just interviewed aprox.60 people for two server positions.Although I'm extremely nice,I ask very difficult questions.Its not like the old days when anyone could walk in and get a server job.Especially in upscale restaurants the competition is extremely difficult.Experience is mandatory and a college education is preferable,not to mention wine and food knowledge.Most of the people I interviewed couldn't answer half of my questions.The two women that I did hire blew me away with their extensive knowledge.I actually felt that they knew more than me! But that's what it takes if you want a sever or bar tending gig in a nice place these days.Even cooking in a fast pace Chinese restaurant involves the ability to multi task for sometimes 10 hrs without a break.These people who put down and discount restaurant workers have no idea what they are talking about.I would like to see them try your job for a day and see how it works out.
Totaly agree with you. I think people are forgetting only 1 person got busted for being a dumba-s-s thief, that does not mean the other 99.99998% of food service workers are thieves, druggies, lazy or what have you. I cooked Chinese food for four years. That IS a skilled job. Women (and guys) running around carrying as many as 4 dinners on their arms at one time dodging kids and drunken idiots ARE skilled workers. Even in the old greasy spoons the waitresses half the time were yelling out the orders to the cook witthout a ticket and got it right most of the time. I used to sit at the Moon cafe in San Diago just drinking coffee and watching the waitress work her magic! And her job too;>)
