Barred businessman at it again under new name
PORTLAND, Ore. -- People who have been ripped off by one businessman are urging others not to follow in their footsteps and trust the man.
Jerry Rosenstiel has been the subject of a few KATU News stories because he's known to state officials as being one of the most complained about businessmen in Oregon. Recently, a whole new crop of people are upset because he hasn't paid them what he owes them.
A group of people gathered along TV Highway and made it known how they felt about Rosenstiel, who was working inside a nearby building. Most of the people are former employees of Rosenstiel, a man they helped to buy and sell cars. They're upset because they never got paid for their work.
One woman outside holding signs and urging others to not trust Rosenstiel was written a check for $2,700 by Rosenstiel. The check never cleared.
Less demonstrative, but no less upset is Mike Cuciti, the owner of CBM Computer Solutions, a small tech outsourcing company. Cuciti spends countless hours on the road servicing computer systems for local businesses.
"He cons people out of money," Cuciti said.
Cuciti was able to produce the bill he gave Rosenstiel and his business partner for computers and computer services he provided to them. He had five used computers, a custom-built computer, a monitor, ethernet switches and other equipment. The bill for all the equipment has yet to be paid by Rosenstiel. That was three months ago.
"He asked me at the end of March, I believe it was, to give him a bill and come back the next day and get paid," Cuciti said. "I came back the next day and he said, 'Well, I didn't get ahold of the bank. Come back again.' This went on and on for a whole month and he even said (the) check's in the mail or we delivered it but it came back because it had the wrong address on it."
Cuciti is out $4,033.25.
"I don't think I'll ever see the money," Cuciti said.
It's the same story, albeit a few twists and turns, other victims have told about their dealings with Rosenstiel. His dealings in Newberg led to an arrest, but he's obviously still at it.
Lately, Rosenstiel has been going by the alias of Jerry Bates because the man named Jerry Rosenstiel isn't supposed to be doing business at all in the State of Oregon, thanks to a ban imposed upon him by the Oregon Department of Justice.
Officials from the Oregon Attorney General's office cut him off from advertising, soliciting, carrying on or conducting any retail sales or service business in the state. That ban was put in place in 1993 -- nearly 20 years ago.
When asked about what he thought about the business dealings with Cuciti, Rosenstiel admitted he owed him money for the computers. He then called his business partner on his cell phone and used the speaker phone function.
"Hey Andy," Rosenstiel said into the phone. "I know you're busy in Indiana. Do you have a copy of the check you wrote Mike for the computers?"
Rosenstiel and his partner said they only owe Cuciti $500 for his services -- a long way off from the bill of $4,033.25 Cuciti had.
Rosenstiel wasn't sure what to say when asked why so many people are unhappy with him due to their business transactions with him.
"I cant given you a straight answer because I don't have one," she said.
Cuciti is still upset about his dealings with Rosenstiel.
"I mean, this guy -- out and out -- told me untruth. He lied. It just made me mad that he took advantage of me. If this helps anybody not dealing with Jerry, that would be wonderful. At least we can save them some heartache."
Rosenstiel said he lives with himself pretty well despite all of the complaints.
"You know what, I do a pretty good job living with myself because half these people are lying and I'll tell you the truth," he said. "And if you want to come in Tuesday, we'll lay everything out. You can lay it out."
Rosenstiel scoffed at the notion that his offer was just an appeasement and that he would never actually show up to the proposed meeting. However, a month later, Rosenstiel still never showed up to any meeting. His reasons ranged from delayed flights for his business partner, cell phone batteries dying to their company's bookkeeper's daughter having two separate back surgeries.
Along with the Department of Justice's ban against Rosenstiel, the Oregon Department of Motor Vehicles has problems of their own with Rosenstiel. Officials there have received dozens of complaints about him buying and selling cars when he's not legally allowed to do that. He's not a licensed dealer, officials said, but he acts like one and DMV officials have assessed penalties against him.
If there have been so many problems with Rosenstiel, why isn't he in jail? That's because much of what Rosenstiel has done falls under the umbrella of civil law, which means people resort to file judgments against him in small claims court, which allows him to escape a criminal prosecution.
Everybody he's cheated needs to get together and take it out of his hide.....
Jerry says a lot of things, he is the master of making up excuses. Andy is here in town and was seen in town when Anna came out to the location we protested in May. Jerry was telling customers and local businesses that Andy was in Indiana picking up titles for vehicles customersm paid for. I recently reported as of 6-28-2012 Andy still hasn't paid for those titles. Andy is hiding, on a good day he can be located at the TV hwy location in the trailer on the back of the property. Follow-up info: Between the RV and the contents of the storage unit, my friend has lost approx $25,000. They reported the theft to local authorities (2 police depts)at the time of the loss, but without an address and last name for the guy they were told -"There's nothing we can do about it & they would not persue the matter". That's why my friend has continued to try to get answers directly from Jerry all this time...knowing it was most likely in vain. Jerry is very smooth and continues to infer that my friends goods are in a unit that can't be accessed at this time. Hope springs eternal...but my friend is not holding their breath! You can never replace the personal memory items that were taken, but some financial recompense would be appreciated. Even if the Justice Dept can find some way to lock Jerry Rosenstiel away, it's not like the State of Oregon has a victims fund that can reimburse any of the losses connected to this crook.
There is one name no one is mentioning. Andrew O Davids is Jerry's business partner with the business license that enables Jerry to rip people off. If Andy was a legitimate business man he would of kicked Jerry to the curb long ago.
Very good point @CaseyDay! I had not heard his "business partner's" full name before, so thank you for sharing that. BTW, I encouraged my friend to add their name and story to the Dept of Justice file. Not sure if the OR Dept of Justice can go after Mr Davids in Indiana though? (At least that's where Jerry "said" that Andy was in the news clip)
Jerry Rosenstiel/Bates didn't just con businesses and employees: A friend of mine just found out that this guy is the one that ripped him off. About a year ago, my friend was going thru a nasty divorce and only had a car, the contents of a storage unit and an RV. The RV had been in storage and mice had gotten in to it. It was also necessary to relocate the contents of the storage unit to a closer location. My friend stopped in to a local UHaul company to ask about storage units and Jerry Rosenstiel(Bates) was working there. Jerry said he knew how to take care of the mice and would help my friend out with cleaning up the RV infestation. Since my friend was low on cash, Jerry also offered to use "his own truck" to haul the contents of the old storage unit to the new location and offered to pick up the RV to work on it as well. My friend has not seen the RV or the contents of the storage unit since then. Because Jerry was "working" at the reputable UHaul business, the friend was not suspicious...just thought someone was offering to be a kind & helpful citizen. The owner of that Uhaul location allegedly ended up having his own vehicle stolen by Mr Rosenstiel/Bates.
My friend has Jerry's cell# and has been in contact with the guy for several months in an attempt to recover the property. Jerry has used many of the same excuses (apparently now Jerry is "gravely ill"...another LIE!!!)  and asked to be called "the next day". When my friend called back this morning, Jerry threatened to come break my friend's jaw. Nice.
The sad thing is that my friend's father had passed away shortly before this whole drama began and all of the family photos and mementos of the father were in the storage unit...along with important family documents, business records, personal goods, etc. Sadly, all of those things were probably sold to a junk wholesaler or are rotting in a warehouse somewhere. Jerry Rosenstiel/Bates is a thief...a predator...
I don't want to see him go to jail and the law-abiding, tax-paying citizens of Oregon get the "honor" of paying for Jerry's accomodations. I'd like to see him under house arrest with a monitoring anklet, wearing a t-shirt with all the rotten things he's done to people written all over it...perhaps something like- "I am a low-life criminal and cannot be trusted". I'd like to see him be forced to work at a menial job (perhaps cleaning out portable toilets?) and have ALL of his pay go towards repaying his victims. He can eat soup and bread and water every day and sleep on a cold floor. It's frustrating to think that even if Mr Rosenstiel actually DID go to jail, he would be able to live more comfortably than the homeless folks in the area. BTW- my friend ended up homeless for several months, partly due to the personal property being stolen as some of the goods...including the RV... were going to be sold to help pay bills. Such injustice!!!

I agree that I should have gotten a down payment, but I was paid for the first batch of technology provided. Of course, I had a bad feeling about this guy, but he paid up.

As a business owner; I agree with BillyBatts. I never provided advanced networking solutions without at least 50% paid in advance, of course, I am also legit. 50% allows me to cover my expenses and then if I don't get paid ...everyone always pays...I can repo the equipment and write down the loss, including the cost of the repo, against my taxes. There have been a few clients for whom I shortened the leash and a few perspective clients that I just passed over.

Being a business owner I have to ask, did any of you practice "Due Dilligence" when granting this dirtball credit?  Did any of you report this guy to any credit rating organization? Granting credit to other businesses is serious business, you must protect yourself at all times. At the worst you can write it off as bad debt.
Why do they keep issuing him a business license? Oh yeah because it puts money in the government's pocket. I think it's time for his victims to "run him out of town"

I'm surprised that the state has not chosen to go after him - after all, taking citizen's money and giving them little or nothing in return puts him in direct competition with them.

The state simply has not chosen to charge him. Writing cold checks is a crime, no matter the amount. Once convicted of the misdemeanor, they can go after him for a class C felony.

So, why can't Charles Manson just change his name, get out of prison and start a nice new cult? This makes zero sense to me. Also it looks like there is enough people to throw this scammer a real nice blanket party, If ever asked about it later, just tell them "it wasn't me, I have a new name now". Sure doesn"t look like he spent his hard earned scammings on a home or clothes.
I believe anything over $1,000 would be considered Theft I and a felony.

I don't understand why, even in civil law, this guy can't be charged with a crime. How is theft from a business any different than ripping someone off for work or computer hardware?

The legislature needs to pass the "Rosenstiel" law that makes it a crime to continually rip of employees.
If he has been doing this for so many years, then he needs to do some serious time behind bars. Working in a gravel pit, making sand. The state needs to toughen up the laws, or actually do something about this person. Or as some people are doing, picket and carry posters wherever he goes. To show others what type of person he is.
