Slain federal public defender fought her attacker

PORTLAND, Ore. – Federal public defender Nancy Bergeson fought back and struggled against whoever strangled her to death that night in her Southwest Portland home in November 2009.
That fact was an important new detail detectives in the case revealed Wednesday to stir up new tips in their effort to solve the case.
The afternoon of Nov. 24, Bergeson was found lying facing down in her dining room by a girl who walked her golden retriever.
There were no signs of forced entry and the items inside the home appeared to be in order. On Bergeson's laptop was the tax fraud case she'd just lost. Her friend, Colleen Scissors, said Bergeson was mad about that. She said they'd been emailing just the night before, around 10 or 11 o'clock.
Detectives have asked Scissors not to share what specifically they were corresponding about.
Initially, the deputy medical examiner who came out to Bergeson’s home thought she'd died from natural causes. It wasn't until later in the autopsy it became evident Bergeson had been murdered. But by then whatever crime scene was at her home, and the evidence in it, had been compromised.
It was a mistake downplayed by Portland Police Bureau homicide Detective Michele Michaels on Wednesday, who said she would not assume it had prevented them from solving the case by now.
"I think that you would have to be God sitting up above to know everything about it to know whether or not it affected anything. It may not have affected anything," she said.
The deputy medical examiner, who initially determined Bergeson had died from natural causes, is still employed with the Multnomah County Medical Examiner's office.
Friends and former colleagues of Bergeson said Wednesday she was relentless in her pursuit of justice and tough on the police and prosecutors on the other side of the aisle.
Scissors said that Bergeson would even be tough on police in her own murder investigation.
"She'd say to the Portland Police Bureau, 'Get your butts going and solve this murder.' And I know they are, but that's what she'd want. She'd want the kind of effort that they are putting into it, because she wouldn’t want this to be let go," Scissors said.
For Bergeson's friends to know now that she fought her attacker, it's what they had believed about her all along. She would not have gone down without a fight.
"She cared about life," said Lisa Hay who worked with Bergeson. "She would have done everything to stay alive. She loved her daughter more than anything, and for her to be gone for her daughter, she would've fought to stay on this earth."
There is a $1,000 Crime Stoppers reward for information leading to an arrest in Bergeson's murder.

I hope detective Michaels isn't the best and "brightest" of the Portland police because her response to the fact the crime scene was botched may/may not have contributed to the lack luster police investigation is OFFENSIVE!!!! Oh Please!!! I might not have a PhD in forensic science but of course the crime scene is important. I'm not sure if she should really be blaming "God" or using "God" as an excuse for why they are failing to solve a murder. This is fishy! Come on!!!!

The circumstances suggest that she knew - and let into her home - the person who killed her.
After 3 years, the police release the information that there was a struggle. Yeah, they're not releasing any info on this, they don't even want Nancy's friend to talk about what it was they were emailing about. They don't want the public to know anything about this case. According to comments on truecrimereports.com there were going to be allegations of jury tampering in the IRS fraud case she just lost. If it was clear she fought back and had defensive wombs, then how was this ever ruled 'natural causes' in the beginning? Something seriously doesn't sound right about this. And now, almost 3 years later they are bringing this up? Bigtime fail here...

This is, or should be old news...it was a well know fact that the suspect had defensive wounds to his/her face and they hit the neighborhood hard looking if anyone who had seen a subject with fresh wounds. If Bodie could talk, I bet he would have lots to say. What became of him? I think she knew the perp and Bodie did nothing because he knew them as well.
This reminds me of the strange missing DA who once worked on the Sandusky case (over a decade ago). They've never found his body, but it is very clear that his JOB had everything to do with his disappearance. This is a similar situation...a woman who dedicated her life to justice, but she has gotten the short shrift! I am glad the information is on the news again and the public is being asked to help. I hope it yields results! From all accounts this was a talented person who made a positive contribution to our community. She fought hard for others...she and her family deserve justice.

Y'know, what gets to me is why they (police) would not keep Ms Bergeson's home sealed as a possible crime scene until the autopsy was complete and the "death due to natural causes" was confirmed.  Â

I agree with felines99 and other posters... there's something not right about the way this whole thing was handled...this just smacks of cover-up...
 @margay1 I agree something smells like bs! I believe there's a logical explanation: The police investigators didn't have enough education, drive and determination to solve this crime or at the very least determine what had happened.
Bergeson had a number of enemies in the Police Department, and some have said that this was an "inside job" -- i.e., that the killer was a member of LE, or someone paid by a member of LE. There is something not quite right about how this crime was investigated, from the get-go.
Nice of them to mention it now. I'm sure anyone would remember seeing someone they knew back in 2009 with suspicious scratch marks on their face and hands. Doesn't seem like they have really put much effort in this case. Sad for her family and friends. I hope they find her killer.
Money talks, so make the reward at least 10k. Meanwhile, let's not assume anything, Det. Michaels. This case will turn on some insignificant detail at the scene--which was compromised. Having said that, go back and interview the neighbors, canvas the place. The young woman who walked the dog, and who found the body, you definitely want to talk to her again. The answer is out there.
Sad. And sadder that there's only a measly $1000 reward in this case.

 @Luckylucy Ya, you would figue if she fought her killer that there would be DNA under nails etc...
And I know they cant divulge too many details but if she was in a fight to the death, how on earth could the ME mistake her death as 'natural'?
