93-year-old man accused of killing daughter ruled unfit for trial

PORTLAND, Ore. – An elderly man accused of shooting his daughter to death and injuring his son has been deemed unfit to stand trial by a judge.

Multnomah County Circuit Judge Jerry Hodson ruled John Wesley Myers, 93, unfit in April and now says he should go to an adult care facility.

Myers is accused of shooting his daughter, Kim Mackintosh, 43, while she slept. Mackintosh died. He is also accused of shooting his son, Mark Myers, 49, in the chest. 

Myers claims he does not remember what happened the night of the shooting. A pair of psychologists claims Myers has dementia, but prosecutors said a police psychologist found no signs of mental illness.

Judge Hodson has said Myers belongs in an adult care facility but prosecutors say staffs at a regular facility are not trained to handle Myers in preparation for a trial.

Prosecutors claim Myers gave a lucid interview after the shootings.

No specific motive for the shooting has been announced but Myer’s attorney claims he was abused in the months leading up to the incident.
