DA: Homeowner shoots intruder who broke into home for 3rd time

WARRENTON, Ore. — Police said a homeowner in the coastal community of Hammond shot and wounded a suspected burglar who was released from jail earlier this week.
Warrenton Police Chief Matthew Workman says an officer heard the shot Friday night, a few minutes after dispatchers received a call from a neighbor saying the homeowner was holding an intruder at gunpoint.
"It just got a little bit wild. There were five cop cars in a matter of, what, five minutes," said neighbor Chuck Still. "I mean they barreled in here."
When the officer went inside, he found 25-year-old Tony Tischer wounded on the floor. The officer calmed Tischer until help arrived, and he was taken to the hospital. Police said he was shot in the buttocks.
The name of the 44-year-old homeowner has yet to be released. Workman says the man gave his 12-gauge shotgun to the officer and has cooperated with investigators.
No arrests have been made.
Clatsop County District Attorney Josh Marquis told KATU News that Tischer was jailed twice for burglarizing the same home in the past. He was released from jail because of overcrowding.
Before releasing him, a judge ordered Tischer to never go near the home again. Marquis said he doesn't know why Tischer kept returning to the same home. It's unclear if Tischer knows the residents.
"We've been in touch with his family, that's concerned about him, I think he may have some mental health or substance abuse issues," Marquis said.

@BCH mom Shooting a bad guy in the back(side) is not all that uncommon, it doesn't mean that the shooter was a coward and shot someone trying to escape, what generally happens is the bad guy makes an aggressive move toward the homeowner, then realizes that the homeowner will not be intimidated, and as the trigger is being pulled, tries to get outta Dodge, and ends up with a buttload of lead shot.

So why isn't he being mandatorily sent off for a complete mental health evaluation and detox? Is the county so callous with our public dollars that they just don't care about approrpriately assessing this man's condition? He is obviously in serious distress and mental conflict. But let's keep on keeping on - letting him out - so he can harm himself and others.
I believe this homeowner had every right to defend his property and his life. He had no other choice.
If jails are overcrowded, execute the worst offenders instead of releasing the "best" offenders.Â

This speaks volumes as to why Oregon needs a working death penalty. The perp. is obviously a completely broken person and either himself or an innocent person is going to die in his break-ins. Obviously the jails aren't working and our legislators have no intention of doing their jobs by properly funding the jails. Kitsaber do your job or resign. Â

What if someone broke into your home, you call the cops, do you know what can happen to you in the 5 to 10 minutes it will take for a cop to arrive? Lets just say i hope the criminal leaves enough evidence behind so that he can be caught and convicted before he harms anyone else.Â

It's nice to know that the justice system protects convicts who want to keep breaking into the same home over and over. The homeowner ultimately had to protect himself. Cheers!

Only arrest that needs to be made is this 3 time loser for breaking into someones house again. No more of this catch and release BS you commit a crime you go to jail.Â

Why did this guy receive a shot in his buttocks? The home owner might shoot from behind, when there is not neccessary to pull the trigger, the guy might be running away. A shot to the chest, head...you name it, is OK as long as shot from the front. But from the back, I smelt some thing wrong here.
The young man keeps coming back the same address, there may be some things we don't know yet.
@tptpttp According to the video, the (wink, wink) suspect made a move toward him (the owner) who counter-moved to shoot the suspect in, for most people anyway, a non-vital area.
Given that the suspect has been there twice before, it may be that the owner actually shot the suspect where his brain resides.

So, if somebody wants to break into your home, all they have to do is walk backward at you.
@tptpttp intruders don't have rights when they invade your home. The home owner has no way of knowing what the intruders intentions are so he had every right to shoot him no matter what way the guy was facing or even if he was running away. Intruders can run away...and then perhaps un jam their own gun, or look for a hostage. The young man is lucky he is not dead. The home owner would have been justified...especially since this guy is a repeat intruder, to shoot him dead.

Of course, for some of you, that's just job security.
The corrections department would be totally at fault if this young man had been killed. It is stupid to simply send the mentally ill back out on the streets once they have demonstrated they are a danger to others or THEMSELVES. This guy could have been killed and hats off to the homeowner for not killing him. It is a horrible thing, for any decent person , to have to live with the knowledge they have ended the life of another human being. The next time they let this guy out of jail, what is to stop him from finding a gun and killing the homeowner? Perhaps instead of letting all those government owned buildings that are unused be put to good use and house/treat these people. But no...it is more important to use government resources to study salmon and squirrel robots. Wake up and get the priorities straight!Â

@scoreboard Shotguns are fun. Back when shooting and drinking was ok, the last target of day, was the Styrofoam cooler. I guess the little pieces of the coolers are still around.
@tally @scoreboard I agree. I love mine. I take it out on the range and have a blast with it (no pun intended). I just hope and pray that I never have to use it in a situation like the story above but I'm glad I have one should I need it to protect my family.
