GRESHAM, Ore. – A homeowner says a serial squatter has taken over her property and refuses to leave.
Joyce Enebo, who lives in Redmond, says 55-year-old Denise Martin has been doing this for 20 years, telling a story to get in a home and then not paying the rent.
Outside the home on Tuesday Martin denied being a squatter. She said she is starting a business at the property centered on organic super gardens and their healthy benefits.
"I have a business that revolves around sacred energy gardens," she said. "So I needed a property to land on. I offered the owner $5,000."
She showed a contract to a KATU News reporter that says she will pay $400 a month to the owner and then an almost $4,000 balloon payment. And she said she has paid the rent starting in June.
"I gave her 400 for the First of July and 400 for August. The balance of $3,075 was due on the nineteenth," she said.
Martin said she refuses to pay the roughly $3,800 balance now because Enebo is having her evicted. Martin also said she won't leave because Enebo breeched her contract and she is taking her to court.
But Enebo said by phone Tuesday that Martin moved in even before the deal was struck and that she really agreed to give her $5,000 up front. She said the contract Martin showed the KATU reporter is bogus and that Martin changed the wording after she signed it.
Martin does admit that there has been a two-decade history of problems with previous landlords or sellers. But she said it was always the owners who broke the agreements after she improved their properties with landscaping and gardens. She is adamant that she is not a squatter and never has been.
One couple, who were former landlords of Martin, told KATU News they lost thousands of dollars in rental disputes with Martin.
In response to a question why there have been so many rental disputes, Martin said, "Because no matter what people commit to they say, 'Yes, yes, yes. I want to the garden. I want to save my life. I want to be part of that.' All they're really saying is, 'Money, money, money.'"
Enebo's son, Jeff Steele, who was at the home Tuesday, agreed it is about money, and his disabled mother was depending on the $5,000 she was promised.
"This is all she has and then somebody comes in and doesn't pay. It just doesn't work that way," Steele said.
Both the owner and the tenant say they want to go to court and it looks like they could get that very soon. A hearing on the matter is now scheduled for Sept. 6.

Why did Thom Jensen  and Dan Tilkin quit investigating and reporting on this story when the legal war is just heating up? They would be attacking me with delight if they could but the truth makes them look like idiots or vindictive participants on Joyce's team. Which is it?
Judge Cheryl Albrecht ruled in our favor that the $12,000+ in missing furniture and personal items was not abandoned and Joyce Enebo had no right to withhold it from us.

Thankfully the Gresham Police agreed to file a police report for Criminal Mischief Case # 713648 what Joyce Enebo did to Cate McEachern's last remains and my White House Dome/Garden art collection. The DA is trying to figure out whether stealing $12,000+ worth of stuff is theft in a civil matter.

The following is a list of our personal property that Joyce Enebo stole or destroyed while it was legally in her custody the last thirty days. She claimed in front of Gresham Police Officer Roley that none of our belongings were in her house and refused us access to look.

If Thom Jensen were to actually investigate this case I bet he would find many of these items in her home. Most of Patrick McEachern's things were inherited from his parents. Their ashes are also missing. My art collection was destroyed ala baseball bats and rain - I have video, photos and witnesses that it was purposely destroyed while in her care - it is against the law.

We have seven witnesses that these items were in the house when she took possession and many many more that would recognize the furniture that Patrick inherited, as well as Denise and Ezekiel's belongings. The law demands that she keep them safe and stored for 30 days. 8 days after we vacated she tried to steal it all until Officer Swaesey and Officer Watkins of the Gresham Police straightened her out about her legal responsibilities. She broke the law anyway. You are all so sure that she is just an innocent victim and law abiding citizen then she should have no problem inviting Thom Jensen into her home to prove her innocence - Today!

Unbelievable. How many times will the "law" prevent JUSTICE to prevail? The judge wasn't allowed to see what evil Denise has perpetrated on other unwitting people by taking advantage of their good will. He simply fell back on what the "law" says because Ms Denebo notified the police too soon.

On Wednesday September 12, 2012 the Gresham Police called me in response to my letter to the Mayor, the Chief of Police and the City Attorney. I wanted to know why the Gresham Police had illegally become a private enforcement agency for a disgruntled homeowner that was feeding them lies.

The Communications Officer for the Gresham Police explained that the Gresham Police had to respond because they were 911 calls  Both on August 13thduring the Notice of Termination period and on September6th before the FED was adjudicated. And the officer noted that if they find that a report was made to 911 based on blatantly false information - they will prosecute. I assured them it was. Judge Lawerence's ruling makes Joyce's crimes clearly identified - ORS 162.375 for starters.
162.375¹ Initiating a false report
(1)A person commits the crime of initiating a false report if the person knowingly initiates a false alarm or report which is transmitted to a fire department, law enforcement agency or other organization that deals with emergencies involving danger to life or property.
(2)Initiating a false report is a Class C misdemeanor. [1971 c.743 §212]

If you issue a 30 day notice on July 17th 2012 and it states that the occupants must vacate the property by midnight on August 22nd, 2012 it is against the law to call 911 on August 13 2012 and tell the police to evict the tenants because they are squatting - no they aren't - they are decidedly legal until the end of the 30 days and the landlord or seller issuing the false report can face jail time and fines. .

It is also against the law to call 911 8 hours after leaving the courthouse with a date for an FED trial and demand entrance into the property because it is an emergency to get some stuff out of the shed. The FED laws do not allow the police to harass people on behalf of homeowners until the entire legal process has been satisfied.

Joyce Enebo and her GANG broke the law twice based on Judge Lawerance's ruling today concerning her legal Notice of Termination. I am asking for criminal charges against her.

The police had to be called as we were trying to peacefully pack our vehicles and vacate the property immediately. We were given more time without being harassed to finish packing our immediate things. The Judge's ruling was black and white. Â Joyce broke the law when she called 911 on August 13 and on August 28th.

You have three days my friend to "GIT ER DONE", time is of the essence. You must cross all the t's, dot all the i's, have documents in hand, ready to share with the court if needed, or asked for by the Judge. Your attorney, advocate, co-counsel, should all be on the same page, aware of all that you know, all information, documents, testimony of others, wittnesses, etc. Ms. Martin has done a lot of this work for you already by uploading much of her life on YOUTUBE. If you watch the custody trial of her son, all on YOUTUBE, you will be able to garner names, places, people, testimony, addresses, locations, and more. This will take time so you must divide the work between your family and friends. Take notes. Make sure you and your mother and family document everything no matter how small you may think it is. A 24/7 surveillance should be kept on the Powell Loop property, this may have already been done by the police? Get your own video footage. Ask your neighbors to keep watch and warn them of this situation. A Tualatin property has been mentioned that they were forced to leave. Get the records from that trial. Washington county courthouse is in Hillsboro, Oregon. Get the records of the custody trial. All of these records are available through the FOIA, Freedom Of Information Act. You may have to pay a fews dollars for copies, get them asap. Some will have to be ordered ahead of time. The custody trial was held in Vancouver Washington. It was brought out from watching the YOUTUBE videos, that the father of Ms. Martin's child now lives in Portland Oregon. His name is on the videos, Wardell Gibson. Find him and ask him to testify. He knows well what Ms. Martin is capable of, how far she will go to pursue her ill perceived convictions. Get all the new Gresham Police reports and records of any calls, complaints, and testimony of people connected to this situation. It has been said on the comment log that "pot" plants were confiscated from the property. Does Ms. Martin have a Medical license to be an Oregon grower. Get the reports. If a Real Estate Agent was involved, he is protected by Omissions and Errors through his/her company. One would think he is on the hook at some level representing Ms. Martin. Find out who this person is, what they know to be true, and what is not true. How did Ms. Martin convince an agent that she had an income or any money at all. How did she get your mother to agree to letting her move on the property. Ms. Martin announces to the Oregonian that it is her house, lawn, property. Ms. Martin is now stating that she is not wrong, nor has she done anything wrong, and that "hell no, I am not leaving, I have a business to run".  Research what business she is running and hold her accountable for any and all proper permits, records, proof of income and receipts. If she is running a business then she has to pay taxes. Find out. Ask all agencies for records. Hold Ms. Martin to the letter of the law and ask her to produce one shred of evidence that she has a business, running a business or has a  business license. If Ms. Martin states she is running a business that helps people with their gardens, make her provide to the courts a sample of the produce that is grown.   If Ms. Martin claims to be running some sort of healing house, check for the zoning of that area to see if it is considered legal. Ask for clients that she has assisted and testimony from anyone that she has actually helped. Ms. Martin is a MASTER at her game. You have entered a chess game with Ms. Martin. Wisdom from the book, The Art Of war must be applied. You have stated already the financial strain this has put on your mother and family. Ms. Martin has proven to dupe Judges, courts, real estate agents, friends, family, police, resource centers for woman with children, etc. The sooner you and your family can get this resolved the better for you financially, emotionally, and for your health and well being.  You have your work to do, but Ms. Martin has provided all the information you will need by her own doing by uploading so many videos for all the world to see. It sure looks like Ms. Martin has all the angles figured out. As an early occupier with a real estate contract, (real or not) the laws of a tenant/landlord don't apply as well. Therefore the no cause eviction won't apply and the water and sewer can't be cut off unless fault can be proven on the purchase agreement ......... if any. She's trying to make a living growing things for a very elite group of customers/clients through the use of a rather fragile facade .... "the magic garden". She sure sounds like a very sofisticated lazy person taking advantage of as many people as possible along her path of dignified illusion. Â

Yes, Denise, it IS all about the money. Taxes, water, sewer, and liability insurance. There may be $500,000 in property but there's yearly expenses on those properties. If you were living in a real space instead of your magical fantasy you wouldn't be taking advatage of the owners and the news would go elsewhere.

Thanks to you, Denise, and your selfishness, the landowner now has legal expenses to deal with on top of the losses of the failed real estate transaction. If indeed the original contract you had with the owners was a legal document and then you changed things to suit your changing needs, you will see some discomfort out of all this. Unfortunately you're dragging the landowner down with you. In my opinion, that puts you at the same level as tweakers.

You seem to know Ms. Martin and have knowledge of other victims of her usury, deceit, and manipulation of the facts. Reading the other comments are quite informative. A reporter from the Oregonian published a news article about Ms. Martin. In this article it is stated that the home Ms. Martin lives in with her partner is up for some kind of contest. Has the reporter of this published news article been contacted about the situation unfolding at the address mentioned in the same article? What kind of, "fame" is Ms. Martin looking for and for what reason? How will Ms. Martin contribute to the greater good of society by becoming famous? Something is way off.......and needs to be looked at by all involved. There is a pattern that has been established by Ms. Martin and her cohorts, that seems almost pathological. If children are living through this conflict and turmoil, then what if any action has been taken to help provide stability and security for them? Children have been mentioned, so who are the parents of these children? Is Ms. Martin and her partner the biological parents? Is Ms. Martin wanting to build gardens to feed people, or is the notion of building gardens the catalyst to seek fame and fortune? Makes one wonder.Â

I only know of her because of the issue at hand. The homeowner is my mom! I believe Ms Martin uses her "gardens" to coonect with people her "victims" suck them in or at least making them think she is doing good. all this stuff ...the news articles, CMT "lawn wars" etc has all taken place after getting into the house. She got into the house via a real estate agent wanting to "buy" with an early occupancy agreement. this is not a "lanlord / tenant" dispute! The child involved is ms martins.... (poor thing) Nobody will do anything, can't turn water or any utilities off even though no utilities have been paid, and are now racking up against homeowner??? police have been involved on more than one occassion and yet still there she squats!Â

Where is the garden? Where? What is grown? Why has this gone on so long? Any information should be brought forth to help the homeowner and her family to stop Ms. Martin from doing this. This has to END! My plea to anyone out there is to NEVER let this lady set foot on your property! She seeks out her victims, is very aggressive and knows what to say to lure them in, yes the homeowner is new to this, she lived in the home for over 25 yrs, and is her first time selling it. She believes in the general "good in people" and this woman knew what to look for, knew what to say, and took advantage of her (believe me she has learned a valuable leson here) Ms martin came with the contracts in hand,  this is not just a case of a renter / landlord dispute... she approached the home owner via a realtor to buy the house with early occupancy agreement, drove out of town to meet the homeowner and made contracts then was to have the realtor formalize, what acrually happened after the contracts were made and agreed upon between homeowner and MS MARTIN was ms martin took the contract scribbled out, changed numbers etc... "she made her own contact" so there is no legal contract EVER, because she voided it! SHE HAS NO RIGHT TO BE THERE PERIOD! she claims that it is all about the money, well you can't really buy a house without money! She needs to be locked in a mental facility or prison for a LONG LONG time,  and whats worse is she has a child involved on this propery, police pulled out marijuana plants from an illegal grow operation on the premises, a flat out homeless camp & drug reminents all over the place! Her kid needs to be taken away from her and this environment!  She needs to get out.... I can say that I live close to this area, and this Denise "weirdo" does have a young child living on this property! From what I have heard also is that there were several law officers there who took a bunch of marijuana plants that she was growing in the "Super Garden"..she was supposedly intending to sell. So where is the law in all this...this woman is getting away with some serious stuff.....c'mon people this woman is taking advantage of disabled people and dragging children into this! Awful

I never lived on their property or had any contractual business dealings directly with them. They were talking about someone else in my circle and either lied or Thom bullied them into confusion. Thom didn't mention that Joyce is pulling benefits even though she owns a home with $197,000 in equity and made me help her get food stamps for her grandson. She doesn't work because she is supposedly disabled yet zips up and down her two-story home. Her and her daughter own $500,000 worth of real estate on this corner yet I am responsible for Joyce, her son and her grandson going down after knowing them three months? Fascinating.

I've been a renter all my life. I consider myself a great tenant and have never left a property worse than when I arrived and paid my rent on time. I have also lived with people who have been great roommates, and some who were walking disasters.Â

I have had my share of great landlords and some terrible landlords. The current landlord we have would be at the top of great. When the tree in front of the house fell on my car, he paid half of the deductible. He responds quickly to any problems.Â

We used to rent from a church. I put them in the not so great category. They were responsible for lawn care, but rarely bothered to trim anything. Weeds would grow 10 feet tall and they wouldn't respond. The property was managed by the Board of Trustees, and everything was done by committee. They literally took the summer off and didn't respond to letters sent, even by our attorney. To fix anything, they had to call a meeting and vote on it. Everything was done on the cheap.  Â

I rented from a very nice couple a few years ago. They were responsible, but very odd. During the holiday season a lighted crucifix appeared on our front lawn... from them. A bit creepy. When we moved out they said we left the place in better condition than when we moved in and issued the deposit refund within 2 days. I had a landlord who I complained about the very old heater not working. He kept trying to fix it when he should have replaced it. One morning I woke up with a bloody nose and gasping for air. Obviously carbon monoxide poisoning. He only responded with a new heater because I had just started working for an attorney a few weeks earlier. I was without health insurance (for the 1st 30 days of employment), and asked him to foot the bill so I could see a doctor. His response was, "sue me". I moved out shortly after.

I've rented from giant apartment complexes, which are ok to manage the property, but terrible to communicate with and get your deposit back once you leave.Â

One thing I have always done with every landlord is to notify them in writing of any and all problems with the place when you move in (along with taking photos), and do a final walk through when you move out. Even the most trivial issues like a cracked outlet cover should be noted. That way, if they try to keep your money you have documentation and you look like an organized and responsible person if you have to go to court.

This woman can blame 20 years of bad tenant history on the landlords all she wants, but the truth is there is no possible way each and every single one of them were bad landlords. The odds are a million to one.

It looks like she had done a lot to improve the yard in the short 3 months that she's been there. It's a very big property with no landscaping whatsoever.  I'm sure a lot of work went into it and I think what she started was the beginning of something beautiful. It's unfortunate that we're learning about what she's doing based on a rental dispute. People with natural talents to grow and nurture plants should be revered. We depend on people like this for quality food and produce. Someone needs to give her the space to do this- she clearly has a talent for it. Living in an apartment wont cut it. I know how it is and it just doesn't work for someone that needs to keep her hands in the dirt.

I'm not saying that I agree that you shouldn't pay your rent or hold up your end of a contract but I do think that the real crime here is being too poor and having a passion and profession that doesn't generate enough income. How is it that someone who creates beauty is a pauper and those that contribute nothing to society, like politicians and wall street execs, live like Kings.

This person has been doing things at the expense of others and unfortunately, this time it is coming to a news station near you.Owner should have done better screening before entering into an agreement with "serial squatter". I am sure this would have gone to court sooner if not for the upcoming holiday, and trust me, the first judicial day after a holiday is chaos in the courts as they are making up for that lost day.
@voiceofreason If she has had problems before with landlords,the she is indeed problem and that is why it pays to background your prospective tenants before entering into a contract.Poor business on the owners part and another strike against the serial squatter.There are methods out there to screen people and if one chooses not to do that, then it becomes "buyer beware" and stuck with legal bills.Where was the son when ,if as he states,mom needed the money ? Son should have helped her with the business end
We had a couple of women evicted from our neighborhood for doing JUST that. They were in and out of rentals for over 15 to 20 years of pulling that crap.

I don't know both sides of the story, but I do know body language and hers is very aggressive and "space invasive" even as she talks to the reporter on camera. Â THAT does make me wonder...usually people who have to get in to someone's personal space and intimidate them are in the wrong and attempting (with body language) to make someone accept their point of view through sheer physical presence. Â Completely possible she's just loud mouthed and bossy, too. Â Who knows? Â The fact of the matter is, there is a history of the same types of stories unfolding, Denise. Â When there is only one common denominator repeating itself again and again through the different situations--that is usually the causative factor. Â Of course, if this is true, you're very clearly in denial about your role in the situation and nothing anyone says will change that.

If you have "balloon payment" money laying around--why don't you just buy a house and call it good? Â Then you don't have to worry about "dishonest" landlords supposedly taking you to the cleaners?
I know that the media loves to paint half-truths and spin biased stories depending on which way they decide to lean. Â So I don't really feel qualified to make a judgement call about either party involved in this mess.

All I will say is...  Most landlords are crooked thieves.  The last two months my landlord has tried to tell me I did not pay my rent and owed them rent + late fees, they even tacked a 3-day pay or vacate notice to my door.  Boy were they pissed when I showed up with all of my receipts from every month for the past two years, including the previous two months they were claiming I did not pay.  This has all been a tactic with them trying to get every tenant out so they can "renovate" the building.

@Ixyavi You are painting untruths about specific people/businessehs. One will always find some bad apples in the barrel, landlords AND renters.Not all are bad in either case.If you have prob with a landlord,you have recourses at your disposal so suggest you use them instead of wasting time blogging about it.

@Denise Martin So now by printing the tele number for the people you state you did not bilk,you are setting them up for an influx of calls and you knew what you were doing by giving out their personal info.
@Denise Martin You prob need to check your facts first.There are specifics on who can and cannot collect food stamps.Many grandparents are raising their grand kids and are entitled to help from the govt for such a purpose while have assets,such as pity BUT that isn't the point here, is it ? You are trying to deflect the real reason for this story and that being you are a serial squatter and have a past doing this...
