Crash victims' families not happy about suspect's pre-trial release
PORTLAND, Ore. – A Multnomah County judge on Monday granted the suspected drunk driver in a deadly Portland crash release from jail before his trial begins next month.
Brent Warstler is accused of driving drunk and causing a crash that killed 20-year-old Rebecca Bray and critically injured 21-year-old Brandi Butner in Portland’s Old Town on Jan. 20. Butner is still in the hospital recovering from her injuries.
The prosecutor fought Warstler's early release, arguing that the man had a blood alcohol level of .20 and was driving twice the speed limit when he went through a red light and collided with a taxi. The taxi forced Warstler’s truck onto the sidewalk where the two women were standing and waiting for a ride home.
Six other people were injured in the crash: Three people in Warstler's truck and another three in the taxi. None of those injuries was serious.
The judge reduced Warstler’s bail from $297,500 to $50,000, which is the minimum for a Measure 11 crime. Warstler's attorney said his client would post bail.
Warstler will be required to wear a GPS monitor and an alcohol monitor that tests him every half hour. He also won’t be able to drive without the court’s permission and will have to attend Alcoholics Anonymous meetings daily, the judge said. Warstler will also be under house arrest until supervisors decide whether he can go back to work.
The judge said it was reasonable to reduce Warstler's bail and that several factors had been taken into account, including a lack of criminal history.
But for family members of the victims, none of that was enough. Butner’s family was in the courtroom Monday morning and begged the judge to keep Warstler in jail.
“Becky’s mom [is] just traumatized over this,” the survivor's father, Bruce Butner, said. “I just don’t understand it, how he can be able to be released. As far as I’m concerned, he murdered somebody out of his own judgment.”
"I do not think it is fair, just or right that Brent Warstler be released to his home before sentence served," said Sarah Bray, the sister of Rebecca Bray, who was killed. "My sister does not have the option to come home. That chance was stolen from her."
"It was an incident created by negligence and utter disrespect - not only to himself, but others he put in harm's way," Bray added.
Warstler did not speak during the hearing but his attorney told the judge that Warstler is a good person and is truly sorry.
Bruce Butner told KATU News on Sunday that if his daughter can’t come home, the man accused of putting her in the hospital shouldn’t be allowed to leave jail.
“Unfortunately he’s taken the life of Becky and pretty much destroyed my daughter’s life at this point,” he said. “My daughter can’t come home. Becky’s never going to come home again. So you have to think about where the law is to even think about allowing him to get out.”
Butner said his daughter still cannot stand up without help, and she can’t hold her 6-month-old son in her arms. He said he had to tell her that the driver accused of hitting her last month could be out of jail soon.
“Her emotions are just going wild right now,” Butner said on Sunday. “She has anger. She cries because [she says] ‘dad, how come this happened to me? I did everything right,’ and she did.”
Brandi Butner's Facebook page reads "I just wanna go home to my son and be better already."
Meanwhile, Warstler’s trial is scheduled to begin March 14. It is important to be clear that this is only a pre-trial release. If Warstler is found guilty at his trial next month, he could go to prison for years.
He has two thoughts in his head right now. Â How can I escape and I need a beer. Â Letting out early on a lowered bail means he going to hit the road.

 @SilverGuardian It's not hard to hit the road after you cut off the ankle bracelet and I don't know about the alcohol monitor.  I"m not familiar with that device so I don't know how "removable" it is.

32jim2....So many DUI's get off and are repeat offenders. Sad to say I've had two in the last 40 yrs. with 20 yrs, between them. The last was in "92 and although I still drink occasionally, I will never get behind the wheel again when drinking. Most of those repeat offenders, and I mean those who have several DUIs' in a short period of time, are out because the justice system puts them there. While awaiting trial, they should never be released, if they plead not guilty. Our justice system sucks big time.
The other concern I have is when people like this comit these type of crime and are found Guilty. They only receive a 5 to 7 year sentence. I want to see the laws changed to really reflect what this crime does to the family of the victim. If we change the law to make judge to have to sentence these people to say a minimum of 10 years it might send a message that Drunk Driving is serious and not just a game.

@splizaat There is nothing illegal about standing on a sidewalk. There IS something illegal about drinking yourself into a coma and then getting behind the wheel and plowing down multiple people. Perhaps if this young lady hadn't been there someone else would have been mowed down instead. Perhaps her mear presenced saved someone else's life. Try not to be so simple minded and blame the victim who was obeying the law AND being responsible waiting for a ride.

So who gets sued if he offends while being out on bail, and reducing the bail? The courts don't see this man as a threat to the public, the scales of justice are tipped and and lady justice has a tear in her eye on this one. Thoughts and prayers to the victims and their families.Â

Hopefully he doesn't kill anyone else while out, I can't believe they reduced the bail, let alone even gave him one!! There are murderers who don't get bail all the time, who may not be guilty, and this guy is 100% guilty and he gets out?!?!?!? Ugh!

Remember the case in clackacmas county where a guy driving drunk hit a cyclist killing him? He got less than 5 years from what i understand for being responsbile DIRECTLY for someones death.

Myself and others included have already said it countless times on here. There is no justice in this system. It serves to benefit the criminals and these cases are PRIME examples. Â By years end DUI crimes will be just a fine....

If the Judge let's him out with provisions, I hope that judge will consider ONE provision being that he must stand for 8 hours a day at the very spot those girls were standing when he plowed into them. Drunk driving isn't a mistake - it's a CHOICE. Â A completely unacceptable CHOICE. Â An indefensible CHOICE.
Going to AA voluntarily, and then being forced into the program, are two different things. Â Going in on your own accord, means that you desire a change. Â Being forced to go, means that you find a drinking buddy who will cover for you because they're in there for similar reasons. Â Jack the total costs of a DUI up, and maybe you'll have a better chance of getting the point across.
I must agree with My2Cents. I have a freind, well more of an aquatiance that was charged with DUI and sentenced to AA.  He puts about as much time into foiling the system, IE knowing when he can and cant sneak drinks, then he does acutally listening to the message.  To him its lame and a waste of time. Hardly the change it is meant to be.    Â

On the flip side financial penalties being punitive dont work either because this just causes one to give up and not care anymore, not that they did to begin with. Besides dealing with addiction problems this same person is now finding they can never dig themselves out of the government cash milking they are getting. they have now had a hard time finding work, going on government assistance, and this depressess them leading to more drinking.

In my opnion we cant just go soft love on these folks either. Excusing their behavior as not their fault is hardly a fix either. For me if I had it my way, they would do hard time, hard physical labor so that the though of using their drug of choice becomes painful to think about. Think of it as operant conditioning.    Â

It was to be expected. Jails are overcrowded, government is out of money and criminals have to be let out. That is a financial fact of life.

Hey Dr R. I think you and I went at it in another story. I understand being a suspect because he has not been proven guilty, YET. To me in some cases (like this one) it is just a given, he crashes his car, he was driving. It is a no brainer; the ONLY thing that has to be determined is if he is guilty of murder or guilty of man slaughter. Keep him in jail and count it as time served.

Yea tell you what we can talk taxes when the government gets its nose out of business it has no business in funding. The fat, bloated, corrupt government spends millions a year in special interests spending. It would funtion just fine if it stuck with, and only with, what it is mandated to. I cant think of a function more appropriate for the government then to maintain public safety. Yet think about the first things they always threatend to cut. The very things they are responsible for. Public safety, schools, roads for example.
