Despite taped confession, accused child molester walks free

SEATTLE -- A local father carried a dark secret for years until he decided to confess his crimes.
Bit by bit, he admitted on tape to molesting his daughter.
His confession was so convincing, prosecutors charged him. But what happened next sent the family into a tailspin and asking, where is justice for Bella?
Bella was a rosy-cheeked, bright-eyed baby. Like all children, before she could form words, she showed her joy in her smile and her frustration in her cries. But Bella had more to tell than she could express.
Her story came out, years later, in tape recorded conversations between her parents. On the tapes you hear Bella's mother, Susan, ask, "How many times did you take her out of the bath and masturbate while she was sitting naked on your lap?"
Her father, Jason, answers, "Oh you know Sue, I don't remember, but it was probably between five to 10 times."
Later on the tape he gives more detail.
"So when she was in the bath tub, giving her a bath, I'd touch her and, you know, kneeling down there next to the bath I'd masturbate," Jason is heard saying.
Susan asks, "Were you stimulating her?" and Jason murmered affirmatively.
Sitting down with KOMO 4 News recently, Susan sighed and said, "This is a long, twisted story."
It's a story that's taken more than a decade to come out. Now 12 years old, Bella also spoke with us, asking us to identify her and explain what happened. She knows she did nothing wrong, and she is not ashamed.
When she was 1, her mother walked in as her father was supposed to be giving her a bath. But he was sitting, pants down, holding Bella.
"I got on to him," Susan said. "I said, 'What are you doing?' He said 'I had to go to the bathroom so I sat down.' I was shaking and I just felt really strange. And scared. But the thought of him molesting our baby? Never crossed my mind - at that time."
It wasn't until years later, when Susan and Jason were divorcing and hashing out their problems in a unique way that she says the truth came to light.
"We would talk and I was very confused, and I think he was dealing with a lot of denial so we started using the tape recorder. We started taping our conversations," Susan said.
Those tapes led King County prosecutors to charge Sherwood with first degree child molestation in 2011. But he was never convicted of a crime. After a short bench trial this year, Superior Court Judge Beth Andrus wrote in her decision, "It does seem odd that when a man confesses to molesting his child, a court might not find him guilty of such a heinous crime."
His confession alone wasn't enough. Without more evidence, Judge Andrus said she had to throw out the charges.
In Latin, it is called "corpus delicti" and translates to "body of the crime." It is the proof that a crime occurred.
Christian Halliburton, an Associate Professor of Law at Seattle University explained corpus delicti.
"There's frequently abundant evidence a crime has occurred and it's proving who committed it that's the challenge rather than the existence of the crime," Halliburton said. "But it also comes up relatively infrequently because while it's an important predicate to prosecution, it's a relatively low threshold to meet. It doesn't even have to be physical evidence. It can be other corroborating evidence -- testimony by eyewitnesses and things like that."
"We thought we had sufficient evidence to corroborate what Mr. Sherwood said," said Rich Anderson, Senior Deputy Prosecuting Attorney for King County. "In this case, the judge didn't agree."
Susan believes prosecutors bungled the case, because they didn't pull a doctor's report from the time of the alleged abuse. The doctor made note of a rash, wrote a prescription to treat an infection, and asked if it was possible that Bella was being sexually abused.
Susan testified about that doctor's visit, but the prosecutor never pulled the report or called a medical expert to talk about it. That surprised three attorneys who reviewed the case for the Problem Solvers.
Each has a working relationship with King County prosecutors and wouldn't go on camera. But one said the county "botched it up." Another said, "they needed independent third party evidence. They had it and they didn't use it."
But prosecutors insist, the medical report wouldn't have made a difference.
"Having a doctor's signature on a piece of paper saying I saw a child's redness to the genital area and then having the mom say the exact same thing when no one's contesting it is, you know, overkill," Anderson said.
Anderson said nothing went wrong in the proceeding, but that the office was reminded of the importance of a thorough investigation.
"It does highlight the need for investigations in general involving nonverbal children to really leave no stone unturned and go for every possible corroborating circumstance that might help support the defendant's confession," Anderson said. "There's a natural instinct when someone confesses to a crime to say, that's what we need. He says he did it. but in order to overcome the hurdle of the corpus delicti rule you have to have that independent evidence. I would just consider it a reminder to investigators that they really have to go the extra mile when the child can't say what happened."
Bella's mother believes the same thing, but that the King County Prosecutor's Office did not go that extra mile.
"I feel they should have pulled those medical records," Susan said. "And they should have maybe had a medical expert come and talk about that. The other thing I feel they should have done is they should have had a child expert there. There was behaviors in her. This child could not talk."
Jason Sherwood walked out of the courtroom a free man, unhindered by these words from the judge.
"The Court does not find that Mr. Sherwood is innocent of the charged crime and neither he nor anyone else should interpret this decision as an exoneration," Judge Andrus wrote in her decision.
When he made those tapes years ago, Sherwood tearfully apologized to his children.
"I've made some very, very bad choices in my life," he said. "I am just so, so sorry."
He did not -- and has not -- won their forgiveness.
Bella recently confronted her father.
"I said how could you have ever loved any of us? And he said, 'I loved you guys very much. Sometimes my actions didn't show it, but I loved you guys very much, and I still do.' And I personally think that's really untrue," Bella said.
After asking him questions and writing down his answers, Bella said she is now done with Jason Sherwood.
"It's been hard for me to look at her beautiful baby pictures and not just see sadness and a little victim," Bella's mother Susan said. "Seeing her muster the courage to talk to her father, I see a survivor now."
She is a survivor who wants her story known and who hopes for no more victims. Jason Sherwood is free. But so is Bella.
This is a travesty of justice for Bella. This man confessed to it, the kid and mom said it happened. What more does the court want; to catch them int he act? I sincerely hope this judge doesn't have kids that this could possibly happen to. Wonder if the case would get tossed then..
Honestly it's to bad we couldn't DEPORT these people to another planet! If there was stiffer laws for people like this maybe we wouldn't see so many repeat offenders. Of course this guy will walk are get a slap on the wrist, cause according to a lot of posters on here only minorities are criminals in this country!
Any time you have a child abuse case, ALL medical records that can validate abuse - should be included. The lawyers failed these children as did the firm they worked for. Law firms SHOULD be reviewing cases to ensure all bases are covered, all possible questions answered before their lawyers proceed. There is NO excuse for this information being available, but not used. Sadly, one more molester out in society and not being marked as such.Â
This is the most disturbing, disgusting, shocking, repulsive, evil story I have read about any molester.  I agree with BREAKING NEWS!!!!! comment and concur "for the love of justice, hang yourself and please hurry".... before you brutal monster Jason gets anywhere near another child or even an unsuspecting adult on planet earth.   I cannot imagine any courtroom allowing this predator to go free... What is wrong with our judicial system?.   Shame on the mother who could not find it in her heart to do the right thing. Her denial is flat unacceptable.    She knew and she allowed it to continue.  Please take her children away from her and please folks, keep your eyes wide open if you live anywhere near Jason or this precious child's mother!!!!  This child is not free for this will come back to haunt her as she gets older.  I actually told a former boss, the mother of a little six year old girl, that the housekeeper had told me the eleven year old brother was caught nude under the covers with his little nude sister. I also told the mother to have her son interviewed by authorities and to get the boy in for help.   A month later I also told the mother that the little sister was sobbing uncontrollably one night while I was babysitting the siblings. I was looking for the children and found the little girl sobbing uncontrollably in the dark garage beneath the house.  She said her brother had "hurt her" and refused to tell me what he had done to her.  Talk about denial... I told the mother when they got home that night what happened and the very next day I was fired.  I then went to the school the children attended and alerted the little girl's teacher.. who also did nothing.  This disgusting behavior goes on in a high percentage of households according to statistics and parents turn a blind eye.   I for one am a victim of molestation by my late stepfather and my gift for telling my mother at age fourteen what was going on was to be beaten to a pulp and called a liar.  People, wake up and pay attention for this abuse goes on constantly and it is often a sibling, a parent, older cousins, and while there are awesome loving innocent stepmothers and stepfathers, the numbers of those being molested are shockingly high..  What is wrong with people?   This happened in my own church in Solana Beach, CA., where a mother trusted the pastor to spend alone time with her pre teen sons (as their father had passed away) and all along the pastor of that Calvary Lutheran Churxh was molesting both of her boys for several years.   This also happened in Rancho Santa Fe when a piano teacher was molesting his young students...  Both of these men are still in prison for their crimes which is where Jason should be..  Please watch the very people you think you can trust with your children.   Sorry to rant but this story is haunting to me and the same goes on all the time and no one hears...   Please keep your children safe ...  Watch the Uncles and Aunts too ..  I've lived it and at 66 years old, I still have nightmares over my childhood abuse...   All the counseling in the world cannot completely heal a violated child...  Karma is karma and these parents will meet their karma one day.... It's so sickening.

@Lynette Walker The Judge has laws they have to apply to each case an a specific burden of proof. They must walk a fine line because any decision they make, someone later can use their ruling and criteria met to skirt the system. It is very important to protect potential innocent victims in the future.

Remember, it was the lawyers job to do discovery correctly. Part of this would be medical records and corroborate information to separate what can be proven and is factual, to what is not. It is a difficult job.

But what I do not fathom is, where is the lawyers that are above this lawyer. Where is the meetings to discuss pending cases, ensure what they have and know is correct and valid, and ensure there are no holes or possible issues. If the law firm did this correctly, they would of noticed this was missing from discovery and pointed it out and had it introduced into evidence. It was her own lawyer(s) lapse in judgement that cost - not just her - but the victims - past and future.
This is a distrubing monster. If he did this to his own innocent baby, I can't imagine what other evil he's done. Jason for the love of justice, just hang yourself, tonight! Seriously Jason, I hope you are reading this. There's no hope for you, just die at your own hand.Â
This mom sure thinks a lot of things should have been done to punish her husband. I think this mom could have done plenty of things to protect her daughter. From one year old, she knew. She's lying to herself and everyone else if she says she didn't. Walking in on him. The doctors comments. Maybe I missed where she took the kids and left.

What else could cause redness? can any one think of what could cause redness? A was rag ? oh it has to be caused by human touching? wait what can cause redness with out a shadow of a doubt? AH there it is with reasonable doubt. It could not be proven with in a reasonable doubt that he in deed do this, sure he can admit to it, but then there are those that can admit to doing things that they really didn't do.

OK I will put this blatantly, the evidence I think they were looking for was Semen on the the or around the vagina as redness could be used from anything and would be hard to prove.
If one didn't "destroy" the individual's life... I see little reason to destory or devastivate another life.  True, this "crime" should not be done! But two wrongs do no make a right.

Remember, our legal system is about justice - and in this justice for the abused. The second part of this would be to mark him as a child molester and in this > a danger to the community in some respects. The community would then be able to access this information and better safeguard their children as well as ensuring he never works in an environment where he can quickly find new victims.

That is some very sick behaviour. On another note, someone needs to hit the guy with smile on his face with a baseball bat that has several large nails in it, just so they can remove his smile. Sometimes, some people.....
His behavior is incurable. The prosecutors should be sued for malfeasance. And the verdict is outrageous. This twerp should be hanged, as should all child molesters, or at least given a frontal lobotomy and set loose on the edge of a 500 foot cliff.
It's not "incurable". Child molesters have one the the lowest redication (sp) rate. 80% of all molesters are family... e.g. mother, father, sibling, cousins. It's the stranger-to-strange molester who have prior arrests and won't stop... THESE are the people we want to put in prison.
Looks like most posters here want to disagree with you. The facts you represent are correct. During my law enforcement career I noted most offenders being charged with sex crimes were not registered sex offenders and were not people who had been through treatment.Â

In my opinion, it would be the people that have easy access TO the children that would be the repeat offenders, since they have more measure of control over the environment, conditions and the child. This would be friends and relatives.

Sorry Bill Rogers but if any Adult touches a Child sexually, then they should be sentanced to very long prison stays or put to Death upon conviction or if they CONFESS.

Are you kidding me? They had the independent evidence, a doctor's report. This is insane that prosecutors could be so dumb or lazy. This guy deserves the boot!
Perhaps Jason Sherwood could show his sincerity by successfully completing a Sex Offender treatment program of the type required by courts and the Parole Board for convicted child molesters. These programs are usually a couple years long (or longer) and cost thousands of dollars, but if Mr. Sherwood really wants to be a better man and examine how he got to such a dark place to begin with, he should be eager to participate in Sex Offender treatment. Well, unless he has no intention of changing...
Another thing that happens when these vile abusers inflict their deviant behavior on victims is the victim never forgets, in most cases never are capable of normal sexual enjoyment...it is lifetime of anger and resentments they are left with...while the perpetrator blithely goes on only to further cause unrecoverable harm.....
This is untrue. Studies have been done on this matter. The child is NOT "brain damaged" for life nor does the child go to live a bitter and hopeless life. 60 to 80% of all "childs" eventually get "molested" before they are 16. Either on dates or with neighborhood kids. The real issue is that the "child" must not get "molested" by another who is more than 5 years older.

@Bill Rogers - I was molested from 6 - 16 by a stepbrother 5 yrs older than me. I am now 50 and am STILL affected by it, even after years of counseling. As silly as it sounds, it all got worse for me when he died a few years ago. Then, there was no hope that he'd ever be able to apologize (not that he would, but the chance was gone). KHEB is right in the last effects.

And how do you know your "messed up mind" is a DIRECT result of these encounters? I know people who have messed up minds, hold great bitterness toward others and have NEVER been molested. And there are people who have seen family members MURDERED... yet they go on to normal lives.  It's SO hard to separate cause and effect.

. This article sumarizes treatment is most effective for the incest type of offender.  Forcible rapists, on the other hand, are a different animal. Saying that 80% are treatable is painting with too broad of a brush. It is clear that the offenders need to be broken down by crime type and victim/suspect relationships.Â

 @KHEB Hi! We were worried about you! Hadn't heard from you since Tuesday night, glad to see that you're still around. Looking at the one photo of Bella as a young girl, I felt bad for her, she looked like an innocence had been stolen from her, and indeed, it had been. She is a courageous young lady, I anticipate she will end up becoming an advocate for victims in the future.

80% of us are "molesters" - depending on one's definition of a molester. A 17-year old petting a 16-yr old "child" is technically a molester.  We're interested in looking at the AGE DIFFERENCE... BUT it's OK for a 21 year old lady to be touched by a 35-year old man... hmmmm.  It's a BIG waste of taxpayer's dollars if EVERY molester was put in prison as the country would quickly go bankrupt.

However 35 year old man, 21 year old woman, NOT A CRIME! You may not agree with the age difference, you're choice. Every molester needs to spend time in jail. I'm 54. I trouch a 21 year old, not a crime, unless it was without her consent. I would not do that, I've nothing in common with a girl 21, but if I chose too do that then you may have an opinion on it, that does not make it a crime.

This story is about touching and molisting a Baby starting at 1. We are not talking about a couple of High School Sweat hearts that one turns 18 when the other is 16-17 and the state steps in. We are talking about messing with you're own daughter who is 1. Another thing is an 21 year old can date a 50 year old that is legal cause the law says it is. But if you touch a CHILD under 18 while you are over 18 that is ILLEGAL. Are we a Nation of LAWS? Â
