Subway sued over short 'footlong' sandwiches

MOUNT HOLLY, N.J. (AP) - Two New Jersey men have sued Subway, saying the world's biggest fast-food chain has been shorting them on its so-called footlong sandwiches.
The filing made Tuesday seeks compensatory damages from the company and a change in practices.
Plaintiffs' lawyer Stephen DeNittis says the company should either make their sandwiches 12 inches long or stop advertising them as footlongs.
He said he's measured sandwiches from 17 area shops and not one has been 12 inches long.
Subway did not immediately return a call to The Associated Press.
The issue got widespread attention last week when a man posted a photo of a sandwich and a ruler on the company's Facebook page.
More than 100,000 people have "liked" or commented on the photo, which has the caption "Subway pls respond." Lookalike pictures have popped up elsewhere on Facebook. And The New York Post conducted an investigation that found four out of seven footlong sandwiches were shy of the 12 inches that makes a foot.
Last week Subwaysaid that the length of its sandwiches may vary slightly when its bread, which is baked at each Subway location, is not made to the chain's exact specifications.
"We are reinforcing our policies and procedures in an effort to ensure our offerings are always consistent no matter which Subway restaurant you visit," Subway said in an e-mailed statement.

The headline should read:Â "Two New Jersey fools with too much time on their hands get a hold of shyster lawyer and file a frivolous law suit to waste the courts time and further bog down the legal system"
@Rob C 503Â Â My foot is 10 1/2 inches long....case closed.
Am I missing something or did the article not mention how much short of 12 inches sandwiches were. Are we talking inches her or a few millimeters? And good grief. This country is law suit happy.Â
So it's the length of the bread that is at issue and not the content of the sandwich? Personally as long as they're putting the right amount of meat and veggies on the thing I don't care if the bread is 11" or 12". Now, if they're skimping on the meats etc. (which they aren't), then there is an issue, but if all the contents of the sandwhich are the same regardless of the bread then who really cares and why?
Sounds like they need a disclaimer, like McDonalds and their "quarter pound" burger. Next we might find out that Subway chicken and beef isn't really "meat" either lol.
 @The Voice of Reason Most of the patties the fast food industry uses starts out as what they claim but quickly reduces down. I think only places like Fuddruckers serve you the claimed weight.Â
Well, if the bread isn't 12 inches long to begin with then all the "6 inch sandwiches" aren't 6 inches because they just cut the loaves in half. So you could end up with a 4 1/2 inch sandwich. Â So I can see the how complaint is justified.
Paging Swimbad.........
Did you get into a tiff with the paper?
He's negotiating with the cleaning lady.
My wife seems to think those two guys were just not used to knowing what a real foot looked like after all those years of exaggerating their own er ah well size....and that is why it took so long to figure out they were short:)
Do these people seriously not have anything better to do??? I'm so sick of hearing about these frivolous lawsuits! Who cares if your sandwich was half an inch too short?? They saved you from eating all those extra carbs over the years - you should be THANKING them!
 @TransplantedTexan if that is your feelings about it... feel free to send me 1/24th of your earnings. No need to thank me either.
Ignorance2012....................your sign on seems appropriate.
 @Ignorance2012  @TransplantedTexan Well they looked at all 17 sandwiches before buying them they could have just handed it back and said it is short no thanks. Instead they are trying to screw subway and all their customers who may pay more if the win...
i guess i am the only one who rips the hunk of bread off the end anyways... i dont want just a huge bite of bread
 @Mr.Q nope...
Class action and I want in!
I figure that Subway owes me about 40 feet.
"Is that the footlong?"
"...and then some."
Just another reason to switch to the metric system.
 @WendyTeagarden We were told to get ready for the switchover when I was in 6th grade. And that was back when Joe Spagnola was quarterbacking the Devils.
Wasn't it called Tempe Normal back then????????
It was, and there was nothing normal about it.
 @Kushfan ~  Oh heck, they were yakking about the changeover to Metric when I was in elementary school.... (Eisenhower was our president then)...  Since then, every once in a while, somebody says "yeah, we really should do that"... but then, it kind of goes away again...Â
I'm suing because buffalo wings don't come from buffaloes.
Sure Wendy, laugh all you want, but this is freakin' serious!!

@Kushfan  ...."in tandem with other factors, has resulted in fewer birds produced overall."
Â
Too many gay chickens = not enough eggs.
The rooster....men always come first.
 @WendyTeagarden Yeah, but which came first, the gay chicken or the gay egg?
 @WendyTeagarden WHAT??? SINCE WHEN????
 @WendyTeagarden lol...and what about the fact that chickens don't really have nuggets?
Â
....or fingers
 @WendyTeagarden Always remember that when the chips are down, the buffalo is empty.
 @WendyTeagarden I believe you're mistaken.
I think this case will get thrown out because even if the bread doesn't stretch a full 12 inches, you are still receiving all of the ingredients of a 12" sandwich. There is just as much dough in each roll (baked in store, but not made in store) and the toppings are pretty much all measured out/regulated. So while your sandwich may be 11.5" it still has the exact same nutritional value of the same ingredients stretched an extra half inch. It's more cosmetic than anything else.
Why isn't anybody obsessing about the amount of stuff they put on the bread. I think the barbecue sandwich was a little skimpy. Â Just sayin....
People have time / energy to obsess about a half-inch or an inch on a Subway sandwich..? Â Â Sounds like maybe some people have a bit too much time on their hands...
I like Subway sandwiches, and as long as they put in enough of the stuff I want (meat, cheese, etc), I'm happy...
Don't swat the small stuff, people... life's too short..! Â :-)
"swat" s/b "sweat"... dam key sticks sometimes...
 @margay1Â
Â
Flies.
Â
I actually do wsat them.
Â
You can choose not to swat small stuff. But i do it all the time.Â
Â
:)
Â
I have exaggerated about an inch or so in the past but I have never been sued!!
 @Pointblank ...chuckle, chuckle...Â
George Castanza "I WAS IN THE POOL! I WAS IN THE POOL!"
Â
To those saying this should be thrown out of court. How would you like to get 10 gallons of gas and pay for 11?
Â
Â
 @AndyP Not even close to the same thing
 @AndyPÂ
How do you like the fact you pay for 10 gallons of gas but really only get 9.9?
Â
It's not like these sandwiches are 8" or 9" or even 10". They are still 11" long. Or about 8%.
Â
You get ripped off from gas stations by more than that (about 10%).
Â
Some variation should be expected.
Â
@Repoman @AndyP Also, we are talking about the bread, not the fillings. Those are all weighed and portioned out. We are literally talking about a mouthful of bread. And anyone who has baked bread knows it is very difficult to get consistent results such as thousands of rolls that are perfectly 12 inches long after baking. This is silly.
We just had this article a little while ago. Â
Do I need to mention my shortcomings again?Â
I may have shortcomings, but I also just met the girl of my dreams.

@Kushfan If she didn't leave her phone number on the napkin, you are out of luck
 @WendyTeagarden OK, so one fantasy came true. Â
@Kushfan go play with your bobble head
 @WendyTeagarden I know.  None of my fantasies are coming true.
