Governor, director defend DHS after judge assails it
PORTLAND, Ore. – Oregon Gov. John Kitzhaber says he thinks caseworkers at the state's Department of Human Services are well trained despite some criticism that workers in the agency are overworked and inexperienced.
"I appreciate the criticisms out there. I also think it's a broad generalization, because there're lots of really experienced, well trained people in the child welfare system," he said.
The governor's comments came after the state's decision to remove two children from the Portland foster parents who wanted to adopt them.
One of the primary criticisms of DHS is that it didn't explain its actions in the case.
State child welfare workers for DHS pulled the children from Brenda Lincoln's and Willie Norman's home in October where they had lived for two and a half years.
The move outraged the children's biological family and Multnomah County Judge Susan Svetkey.
The judge said "the timing of all of this is concerning and suspicious."
She also lectured DHS saying, "What happened to them (the children) is exactly what the therapists have told us is the worst thing."
Additionally, the judge said in court she's frustrated the Legislature didn't give judges the power to tell DHS what to do.
DHS wouldn't and didn't have to explain its move to the judge. Erinn Kelley-Siel, DHS director, said the agency is being as transparent as allowed by law.
"I know it's very frustrating for the media and for the public, and it's hard for us as well, because sometimes we have a story to tell and we can't in the interest of protecting the privacy of the children and families that we're serving," she said.
Regarding the Lincoln and Norman case, Kelley-Siel said "that is one of those open cases that we'd be happy to talk more with you about within the constraints that we have. And we certainly understand that we're not perfect all the time. We make mistakes, and it's a human system.”
Pamela Butler with Children First for Oregon said her organization gets a lot of calls from foster parents.
"(They) don't understand decisions that are being made, and they're not involved and valued and honored in the process. And the same thing with kids in the system," she said.
Butler and Children First for Oregon are behind a proposed Foster Children's Bill of Rights (Senate Bill 123) to allow Oregon foster children more protection and voice in their fate.
"You've got cases where, like we've seen recently, a judge feels one way, a lawyer feels another and a caseworker feels another way, and they don't sit down to hash out why they feel those ways and to bring all the information to light that each of them has," Butler said. "A lot of times there's the asymmetry of information between all the key players and at the end of the day who gets hurt by that? It's the kids."
During a news conference Tuesday at the Capitol, Kitzhaber and Kelley-Siel celebrated a new way of doing business and pledged millions of dollars to a program where child welfare workers try to keep kids with their families by helping moms and dads improve their parenting skills. The state hopes to avoid charging them with neglect.
Budget cuts mean DHS is working with only two-thirds the staffing it should have. Critics also say DHS caseworkers are often inexperienced and ill trained.
As for whether the state should be putting money toward DHS, Kitzhaber said, "Some of it is going to beef up the staff. It's hiring more workers. But it's also being investing in training as well. Again, I'm going to push back and say there's a lot of staff that doesn't need re-training and doing a really good job day in and day out."
Oregon is always high on the list for the number of kids put into foster care. The latest data shows more than 4,000 kids entered foster care in Oregon in 2011. That's the lowest number of kids in the previous five years.
Several lawmakers have been looking into the Lincoln and Norman case and the foster care system. But it’s too soon to propose anything.

On an AMAZING note.... there have been caseworkers in the past week or so (AFTER these news articles and all the comments) who are canceling their scheduled appointments with their "victims" to get on that paperwork they have been so conveniently been ignoring for some time now. GO FIGURE

Absolutely nothing good comes of having child welfare in your life NOTHING!!!! Except in very extreme cases, the children should be left with biological parents or biological family. The "experts" are only expert in concocting "evidence"Â to entrap biological parents into having to have their healthy, well balanced children put into the system when the parents won't vaccinate and feed kids organic only diets. Get child welfare out of your home NOW, they all need to be fired. The agency needs to be gutted from the top down. Including all of the judges that rubber stamp anything the case workers want. I had to go to classes to become a foster parent to my own grandkids. Kids that had spent there intior life in our home. I had to promise my wife before every class that i would not open my mouth and tell them what i felt about the subject for that class. They said it is better to let a 2 year old who can not see over the top of a shoping cart in the store push the cart. So it is better for the child to bump into people and iteams in the store then it is to explain to the child why he can not push the cart. I held onto the cart and let him push but he got worse and did not want me to hold the cart. Then i was told that I should have gotten him a smaller cart (they did not have one). My solution to him throwing a fit was to take him home. On the way home he settled down and was back to his normal self. i tried to explain to him why he could nto push the cart. They told me that i did the wrong thing.Â

They said you can not hug a child because you do not know what they have gone through but in the training guide its states that you can hug a child. My nephew was investigated by DHS because he told his son who just finished a soda and asked for water that he could not have one yet. They were on the road. His son reported him to DHS and acussed him of not getting him the water and not meeting his his needs.

There are good and bad things about DHS. Because of the Federal and state laws our kids are being turned into the "You can not touch me, I will call the Cops" or the "You can not tell me no, i will call DHS on you". generation. The power to descipline your child is taking away from you and now the kids have the power to do what ever they want. I have heard kids telling there parents they will call the cops on them if they touch them. My daughter was hit in the face by a ball a kid through at her after i told him to give it back to her. He told me i could not do anything about it because he will call the cops if i touched him.

There is no fine line between discipline and abuse it is all put in one big pile uder the term "ABUSE".
All state agencies are working well below full staffing. No matter what there is still something called accountability. Screwing with kids lives is a very emotional issue, and should not be taken lightly. I just think the social worker should not be the last say when it comes to the fate of these kids.
of course they're inexperienced and ill trained. It requires a 4 or 6 year degree and tons of student loan debt and it doesn't pay doo-doo. The job is so stressful and emtionally wrenching that people quit regularly. I knew a girl that was a social worker for DHS and she went home crying every night. She couldn't wait to quit. Until we decide that childrens needs should be sufficiently funded, this is how it's going to be.
Why even listen or trust a governor that had publicly stated he was not going to obey his oath of office as it conflicts with his oath to be a doctor. Seems funny only the accussed organization and the governor say no foul was done..... When does the accussed ever admit they committed a wrongful act?
Just damage control by the Gov and DHS. It's all the fault of not having enough funding? Sure! More money solves everything, doesn't it? Even if it is, perhaps a trade for additional funding could be negotiated in exchange for judicial oversight and accountability? That's called compromise, Gov K; try it sometime! Â
Two and a half years? Why is it that it takes so long for DHS to place these children for adoption? Are they afraid they might solve the problem and then not have work?
The goal is to either return them to their parents or place them in permanent homes. Kids need a stable environment. A permanent, stable environment!
This is a case of the blind leading the blind- may seem like a nice thing to do but in reality they get nowhere fast. Gov - get your butt out there and talk to those involved. Confidentiality is a smoke screen here - the people who really know - advocates (CASA's) volunteer their time and go through extensive training, they work one case at a time and they become immersed in the details - more so than anyone else ((who is not a concerned family member). The judge reads all reports from caseworkers, CASA's, and attorneys and they are also very well informed. In my years as an advocate I have seen MANY inept case workers and the random good one. These are children's lives we are impacting and all information should be weighed without DHS having the final say regardless of all others. After all it is the best interest of the child we should be concerned with - ineptness on the part of DHS should not be swept under the rug by anyone! Hear me Gov????
So let me understand this situation with the two black foster parents that wanted to adopt the two white kids. Apparently, everything was fine with this situation for 2 1/2 years, and the kids were doing well, and DHS had no problem with it, until the parents decided they wanted to adopt the children. Then, all of the sudden, without any justification, or clarification, DHS claims they need to remove the kids to another Foster Home? The judge and therapists seem to be the only ones with any common sense here. DHS can tell a judge and therapists to frack  off, and give no reason whatsoever, in the best interest of the children? And John Kitzhaber defends this? Let me know when this State elects a governor who has a clue. While I'm at it, that goes for the mayor's office in the state's largest city as well.

DHS are racist in this case and have them say they found a better home for you just because you'll African American and the kids where doing really good and the real mom wanted them to be adopted by them the problem is this caseworker is a racist and DHS members of ACLU will prove it in lawsuits against them soon. My Mom and others of the ACLU agree on this case it was all about race in this case...

I personally have been screwed over by CPS and DHS, no my children were not taken from me. I am good Mother but their lack in TRUE investigating is a REAL CRIME!! They destroyed my now Husband's finances, future employment and his emotional well being. They ruin families just plain and simple, sorry DHS but you do... I would love to tell my our story to Katu or an Organization that looks into how they handle their internal going's on at DHS.

I am sure there is soom good that comes out of DHS but from my experience last year was the worst thing I could ever experience or watch some one else go through.

LOL over worked and under paid LOL that is a joke. They make great money, have super great benefits, get more days off and their vacation days are numerous. Their case loads are high, but they have so many days off, when they finally do go to work, they are over worked. Try calling a case worker and leave a message, it will be a week before you hear back....out sick, out of town, on vacation, don't work on Tuesdays or Fridays.

And take a look at Erinn Kelley-Siel, DHS director...how old is she? and she is the director, the head of the state program. Standing there admitting this government agency makes mistakes and is only human, BUT they don't need more training....As she stands there wearing her designer clothes, expensive jewelry (that necklace was at least 350.00) and that belt was surely the same price, then add that perfectly groomed and colored hair (not cheap either)....and this is the image that works with and goes into foster parents homes and plays God. This is the look that takes children from their parents.Â

@Tyler Van Pelt Very well said. This is only the big picture. Check out our local prisons. Check the inmates and find out who came from abused foster homes. I feel sorry for some of our inmates that were taken away from their families, put in foster care, never taught love and family values. Then they are thrown on the streets, of course they resort to crime to feed themselves, they don't know any better. Start from the beginning, you can save the state alot of money. It does not stop once the child turns 18 it carries over into our prison system. Like I said a total investigation needs to be done and the entire system needs to be restructured. Somebody has to wake up and stop caring only about the money they make on their job and start caring about the children. Don't walk with blind eyes and hope the system will fix itself because it will not.
Perhaps heads inside of DHS should roll - instead of more money should FLOW? Perhaps the Governor should praise this JUDGE and put him in charge of DHS?Â

Also parents who's kid are put in foster care in Oregon get abused by others in the system and if the get hurt then you can sue DHS for not protecting your kid.

This a joke that the governor supports DHS decision. But in this case this it has to do with race DHS open that door for what the caseworker said in front of the foster parents saying that we found better place for you to live just because they wanted to adopt them. This is a civil rights violation also next the aclu are getting involve the Oregon government is corrupt and DHS is racist when it comes to a black family adopting white kids. Lawsuits will prove that DHS are abusing there powers and abusing kids themselves.

This sounds like a whole lot of smoke-and-mirrors to me (as usual)... and insofar as the 2 kids they're moving around like pieces on a checkerboard, I think  DHS should absolutely have to answer to the judge for their actions.   Granted, not everything needs to - or should - be made public, but a judge should have access to the full story.
So did DHS make a mistake placing the kids there in the first place or did they make a mistake pulling them out? Seems to me somewhere they made a mistake. I understand confidentiality and why they can't necessarily explain to everyone why they have made this decision but it seems to me explaining it to the judge who can then say it is a good or understandable decision would be ok.
And you, the majority of the citizens of Oregon, elected this clown, not once, but twice. Be careful what you ask for because you just might get it.Â

DHS needs to be really looked into... a full investigation done. It is pretty bad when Caseworkers consider themselves as GODS.... they are not.. the majority of the caseworkers really do not have a clue as to what is going on or do they even care. DHS is in a sad state of affairs and needs a complete work over and investigation done. Spend the money keeping the children with their families.. don't remove a child from a bad home and put them in a worse Foster home. Check out local prisons! Do a study.. just how many of our inmates were once DHS foster children. Talk to them and get their imput on just how DHS is.

Personally I would rather see millions spent on teaching these breeders how not to reproduce. I have yet to hear an overwhelming cry from taxpayers who want to shoulder the responsibility of irresponsible breeders who are never held accountable. Make child abuse and child neglect a felony with a minimum prison sentence of 3 to 5 years. We need to stop treating the symptoms by throwing millions and millions of dollars at them and start treating the problem; which is irresponsible reproduction.

Well, that's a very dangerous step for a liberal to take. If you let the state put any constraints on someone's reproduction you just might have to let the state put constraints on abortion too. They won't allow that for any reason.
@ormom How do you misconstrue my statement about "teaching breeders how not to reproduce" into constraints on abortion? If the State teaches irresponsible people how to be responsible, not reproduce until they are mentally and financially prepared to take care of children, and ways to avoid reproduction, the cost of prevention will be far less than welfare, ADC, DHS, etc. We are talking rational prevention here, not taking away someone's rights. A different way to look at it is that nobody has the right to reproduce and expect taxpayers to support the child because the reproducer cannot or won't.Â

Kitzhaber killing the gillnet fleet will possibly put more kids into DHS care as the parents no longer have the income to care for their children. Sometimes killing small businesses have effects that the Governor didn't count on.
