Recount in 2 Clark County legislative races

VANCOUVER, Wash. (AP) - Two close legislative races in Clark County are going to an automatic recount.
County Auditor Greg Kimsey told The Columbian there will be a hand recount next week of 58,994 ballots cast in the 17th District.
That will determine the outcome of the state Senate race between incumbent Republican Don Benton and Democrat Tim Probst. Benton has a 78-vote lead in election results certified Tuesday.
The other recount will decide who wins Probst's old House seat. Democrat Monica Stonier has a 139-vote lead over Republican Julie Olson.
This year, Democrats were the majority party in the state Senate, 27-22. A Benton win means the Democrats would have a 26-23 majority for the 2013 legislative session.

If it is still deemed a tie, then what ? A special session for for these two? I think that if there is an official tie there should be a re-run of voting for these 2 it would be fair.
 @lee986321 Nobody said it was a tie.  The official results so far on the state website show Benton 27,538, Probst 27,460.  This is just an automatic recount because it is too close to say that a few miscounted votes wouldn't make a difference.  After the recount if Benton is still ahead then Probst could accept or possibly ask for another recount or sue for one.  If Probst wants to save face, he'll just concede this race instead of trying to draw it out like Al Gore in Florida.
